199. To ask the Minister for Housing, Planning, and Local Government if his Department has examined the possible effects of measures in the Land and Conveyancing Law Reform Act 2009 which make it necessary for all rights of ways to be registered by 2021 in view of the fact that his Department now has responsibility for the PRA; the practical effects this will have on the system; the progress made to date to promote and encourage land owners to register their interests before the deadline; if provisions will be made for farmers regarding accessing septic tanks and so on; and if he will make a statement on the matter. Under the Registration of Deeds and Title Act 2006, the Property Registration Authority (PRA) was established as and from 4 November 2006. The PRA replaces the Registrar of Deeds and Titles as the registering authority in relation to property registration in Ireland and, subject to the above Act, is independent in the performance of its functions.

I am advised by the Property Registration Authority that the Land and Conveyancing Law Reform Act 2009 changed the law in relation to certain easements and profit à prendre i.e. those acquired by prescription and that it is not necessarily an obligation for all rights of way to be registered by 2021.
