Question 446: To ask the Minister for Justice and Equality if the gardaí have supplied all the information requested by the Garda Síochána Ombudsman Commission in respect of the complaint made by a person (details supplied) in County Offaly; if he will ensure that the complaint is completed without delay; and if he will make a statement on the matter. The Garda Siochana Ombudsman Commission (GSOC) is an independent statutory body which was set up under the Garda Siochana Act 2005 and has oversight functions in relation to the Garda Siochana. GSOC reports annually to me in relation to the performance of its functions and their annual reports are laid before the Houses of the Oireachtas. As Minister for Justice and Equality, I have no function in relation to the processing by GSOC of individual complaints referred to it for investigation. Requests for information regarding the status of such complaints should be addressed directly to GSOC.

Question 447: To ask the Minister for Justice and Equality if the internal Garda inquiry has taken place into the case of a person (details supplied) in County Louth; if so, the action that has been taken as a result; and if he will make a statement on the matter. [34318/11]

In July 2009 the Garda Commissioner forwarded to my Department and to the Garda Síochána Ombudsman Commission a detailed report of the Garda inquiry carried out by an Assistant Commissioner into events related to the case to which the Deputy refers.

This case is the subject of an ongoing public interest inquiry by the Ombudsman Commission under section 102(4) of the Garda Síochána Act 2005. In the circumstances, therefore, I believe that it would not be appropriate for me to make any further comment about the case pending the outcome of the Ombudsman Commission's work. If any action on my part is required as a result of the Ombudsman Commission's investigations then I will take it.
