Question 495: To ask the Minister for Health the reason the parental consent form (details supplied) for dental service in the Cavan-Monaghan area accepts the consent of one-parent only and does not adhere to the staff guidelines for obtaining consent for non-emergency treatment services from parents of children and young people under the age of 18 years [31946/11]

While serving as an opposition TD, Minister Shortall asked a question on consent at http://debates.oireachtas.ie/dail/2009/01/27/00184.asp#N6 referring to the Procedure for obtaining consent for non emergency treatment/services from parents of children and young people under the age of 18 years http://www.hse.ie/eng/services/Publications/services/Childre... are not being adhered to.

The eventual response at http://www.hse.ie/eng/about/PersonalPQ/PQ/ will be interesting!

The HSE response at http://www.hse.ie/eng/about/PersonalPQ/PQ/2011pqs/oct2011/Cl... claims that "The document, as referenced in the question, is a guideline and therefore not policy".

That simply isn't good enough as, according to the Part 3 of the HSE Code Of Governance http://www.hse.ie/eng/about/Who/Board_Members/codeofgovernan... states that
"Part 3 of the Code is concerned with the organisational financial and operational control procedures. These include a wide range of written policies, procedures, protocols and guidelines,. (PPPGs). These PPPGs and standards of behaviour, applicable to all HSE employees are essential to ensure that organisational governance in the HSE is robust and effective.
That means that guidelines are applicable to all HSE employees and essential to ensure the organisational governance in the HSE.
A clarification is now called for!!!
