Question 150: To ask the Minister for the Environment, Heritage and Local Government if his attention has been drawn to the new regulations regarding grave digging introduced by Cork County Council; if they have been approved by him or his predecessor; if any other local authority has sought to introduce or approved similar regulations and if he will seek to amend these regulations to respect family traditions or if he will make any other amendments to these regulations; and if he will make a statement on the matter. Section 199 of the Local Government Act 2001 provides that local authorities may make bye-laws for or in relation to the use, operation, protection, regulation or management of any land, services, or any other matter provided by or under the control or management of the local authority, whether within or without its functional area or in relation to any connected matter. The making of such bye-laws is a matter for decision by individual local authorities and is a reserved function of the elected members under Section 199 (5) of the above Act. My Department does not hold details of such bye-laws in relation to graveyards.
