Question 264: To ask the Minister for Justice, Equality and Law Reform if he will reconsider his decision not to grant a certificate of naturalisation to a person (details supplied) in County Cork in view of the fact that this person is just under the one year continuous reckonable residency in the State immediately preceding the date of their application and that if he has to reapply he would be waiting a number of years before a decision will be made. An application for a certificate of naturalisation from the person referred to in the Deputy's Question was received in the Citizenship Division of my Department in February 2008.

On examination of the application submitted it was determined that the person in question did not have one year's continuous reckonable residence in the State immediately preceding the date of application. The person concerned was informed of this in a letter issued to him on 25 July, 2008. This is a statutory requirement as set out in the Irish Nationality and Citizenship Act, 1956, as amended.

It is open to the person concerned to lodge a new application for a certificate of naturalisation with the Citizenship Division of my Department if and when he is in a position to meet the statutory residency requirements.
