Question 311: To ask the Minister for Justice, Equality and Law Reform if it was appropriate that contributions paid under the superannuation scheme by a person (details supplied) in County Galway could be refunded, while this person was in prison to their family without their knowledge, approval or consent; and if he will make a statement on the matter. Article 15(2) of the Garda Síochána Pensions Order, 1925 provides that, where a member of An Garda Síochána is dismissed for misconduct, the Minister for Justice, Equality and Law Reform may, with the consent of the Minister for Finance, apply the whole or any part of the refund of superannuation contributions paid by the member for the benefit of his wife or children.

The ex-member in question was dismissed from An Garda Síochána without entitlement to superannuation benefits. Accordingly, pension contributions paid by him were refunded to his wife in accordance with Article 15(2) of the Garda Síochána Pension Order, 1925.
