Question 386: To ask the Minister for Justice, Equality and Law Reform when a residency permit will be renewed for a person (details supplied) in Lucan, County Dublin; and the reason for the delay in the renewal of this residency permit. [38823/05]

The person concerned sought to renew his permission to remain in the State on the basis of EU treaty rights. In order to qualify under the relevant regulation his EU spouse must be working and residing in Ireland. The case was the subject of High Court proceedings which were determined in March 2005. On foot of the High Court judgment further inquires were carried out by my Department concerning the current whereabouts of his wife. It was established that his EU national spouse was not residing in the State. The renewal of his permission to remain was therefore refused and he was informed of that decision on 13 April 2005. The position remains unchanged.
