Question 331: To ask the Minister for Justice, Equality and Law Reform when a decision will be made regarding an application for naturalisation by a person (details supplied) in Dublin 22. [24418/04]

The person in question arrived in the State and made dual asylum applications under separate names in September 1999. He withdrew one of these asylum applications in August 2000. His asylum application under his true name was refused on 8 February 2001. He subsequently applied for residency on the basis of parentage of a child born in Ireland in June2002.

Following the decision of the Supreme Court in the cases of L & O, the separate procedure which then existed to enable persons to apply to reside in the State on the sole basis of parentage of an Irish born child ended on 19 February 2003. The Government decided that the separate procedure would not apply to cases which were outstanding on that date. There are a large number of such cases outstanding at present, including the case to which the Deputy refers.

Since the person in question does not have an alternative legal basis for remaining in this jurisdiction, the issue of permission to remain will be considered, but only in the context of a ministerial proposal to deport him. If, in the light of representations received and the range of factors set out in section 3(6) of the Immigration Act 1999, the Minister decides not to make a deportation order, he will be given leave to remain on a humanitarian basis. There is a large number of such cases on hand and I am unable to say at this stage when the file will be examined.

I have been informed by officials in my Department's citizenship section that there is no record of an application for naturalisation or a declaration of post-nuptial citizenship having been received from the person referred to the Deputy.

On 16 October 2002, applications for naturalisation from the persons were submitted to my Department's citizenship section. To finalise the processing of the applications, some additional documentation was sought by my officials in November 2003. The documentation is still outstanding. It is not possible to finalise the applications until the requested documentation is received.
