The section creates the right for people to be compensated in circumstances where there is a breach of their right to have proceedings dealt with "within reasonable time". I have two questions about "reasonable time". I know that later in this section, there is an expansive definition in section 11(4) of what factors will be considered for what constitutes "reasonable time". The Bill obviously does not concretely or definitively define "reasonable time" because it will depend on each case, nor does it define what the compensation means. I know there will be a proper assessment process for that. Will the Minister of State give an indication of what he would consider to be a reasonable time, even as an average time, or what he would consider to be reasonable compensation in the event of a breach under section 11(1)?

As the Senator said, many factors will have to be taken into account. It would not be appropriate for me to give any indication as it might be taken as an indication of what should be granted in a particular set of circumstances. The complexity of the case, the conduct of the parties to proceedings and the importance of what is at stake will all be taken into account in making those decisions.
