I move:

That, in accordance with the recommendation of the Committee on Parliamentary Privileges and Oversight pursuant to Standing Order 98(2)(b), the Orders of Reference for the Seanad Select Committee on Scrutiny of Draft EU-related Statutory Instruments, as agreed by Order of the Seanad on 7th December 2022, as amended on 4th July 2023, be further amended as follows—

(1) By the substitution of the following paragraph for paragraph (5):

‘(5) the Committee shall have power to require any Government Department or instrument-making authority concerned to:

(a) submit a Memorandum to the Select Committee explaining any Statutory Instrument under consideration,

(b) attend a meeting of the Select Committee for the purpose of explaining any such Statutory Instrument: Provided that such Department or authority may decline to attend for stated reasons given in writing to the Select Committee, which may report thereon to the Seanad, or—

((c) submit a Memorandum on any infringement relating to the transposition of a Directive, including infringements giving rise to the imposition of a financial penalty;’. :

(2) By the insertion of the following paragraph after paragraph (7):

‘(7A) the Committee shall have the power to: (a) examine the matters affecting, or relating to, the transposition and implementation, by Statutory Instrument, of any Directive, and (b) examine any infringement relating to the failure to transpose, in whole or in part, any Directive, including infringements giving rise to the imposition of a financial penalty;’.

(3) By the substitution of the following paragraph for paragraph (8):

‘(8) the Committee shall have the power to refer any proposed Statutory Instrument and associated documents, or any matter examined under paragraph (7A), to the relevant Joint Committee and to recommend to that Committee that the proposed Statutory Instrument or matter examined be further scrutinised;’.

(4) By the insertion of the following paragraph after paragraph (8):

‘(8A) the powers and functions of the Committee are conferred upon it for the purpose of exercising its powers under paragraph (8);’.”
