European Arrest Warrant (Amendment) Bill 2022: Motion

An amendment made to the Bill in this House required further amendment. The amendment was made by the Minister of State, Deputy James Browne, in the Dáil yesterday and now returns for consideration in this House. By way of background, two amendments were made on Seanad Report Stage, one each to sections 9 and 10 of the Bill, which amend sections 15 and 16 of the principal Act, respectively. Those particular amendments clarified the obligation that where the consideration of an appeal or an Article 40 application prevents the determination of the surrender proceedings within the relevant time limit, the High Court must inform the issuing judicial authority and Eurojust giving reasons for the delay. The two amendments serve the exact same purpose and as such are identical. Unfortunately, the words "on conclusion of those proceedings and" were inadvertently omitted from one amendment. This was amendment No. 6 on the list of amendments made by the Seanad on Report Stage and was No. 13 in the consolidated Committee and Report Stage amendments considered by the Dáil yesterday. I ask colleagues to accept this minor technical amendment so that the Bill can be enacted and commenced as soon as possible.
