Regulation of Providers of Building Works and Building Control (Amendment) Bill 2022 : Committee Stage

On the issue of compensation, there is a register and a set of criteria that a provider must meet to get on the register. For example, if a registered provider is messing and a complaint is made to the registration authority, the provider can perhaps be sanctioned or struck off the register, but that is no good for redress. There should be compensation for the remediation of works. We wanted this section to go further. Obviously, our amendment has been ruled out of order, so I will not speak to it. We would a provision to be inserted dealing with remediation or providing for compensation for the remediation of building defects caused by a registered provider. If a consumer who gets work done finds that something goes wrong and then checks the register and finds that the registered provider was not registered to do the work, it is not great if the registered provider is just struck off the list. There should be some provision for compensation as well.
