To clarify, an coimisiúin will not have a role in the investigation or prosecution of individuals for offences specified in the criminal code. That is the role of An Garda Síochána. The role of an coimisiún is to implement a regulatory framework to minimise the availability of online content by which those offences listed in Schedule 3 of the 2009 Act, as inserted by the Bill, can be committed. The effect of this amendment would be to require that an coimisiún determines whether aspects of the regulatory framework are necessary and proportionate for an investigation or prosecution, which is a matter outside of its competency. Accordingly, I cannot accept the amendment.
