I move amendment No. 1:

In page 7, between lines 10 and 11, to insert the following:

“Report on the rights and protections of the smuggled person

5.The Minister shall, within 12 months of the passing of this Act and on a bi-annual basis thereafter, lay a report before both Houses of the Oireachtas outlining— (a) the steps which have been taken to ensure that the State has reflected the 1951 Convention relating to the Status of Refugees, including the principle of non-refoulement in all aspects of the operation of this Act, and

(b) the number of cases taken to the European Court of Human Rights and the Court of Justice of the European Union initiated by persons who have been the object of people smuggling or have been prosecuted under this Act and the results of such cases where they are available.”.
