The GDPR came after that EURODAC regulation so it is the more recent law. Perhaps it is due to the vulnerability of the persons affected that cases have not been taken but I imagine when they do take cases, they will be successful. While the EURODAC regulation allows us to have the database in that regard, we should look to best practice both in terms of our obligations under GDPR but also in terms of the fact Ireland has constitutionally recognised the rights of the child, so we should aim for the highest standards. We are certainly not obliged to take children's fingerprints without their parents’ consent under the EU regulations.
