Yes, if the amendment is agreed to. We cannot assume what the people are going to say.It is a different matter if expression is geared towards inciting hatred or violence. I think the Senator is gesturing in that direction. That debate would be very important and very useful. Where that intention is there, the criminal law must indeed come into play.
