Data Protection Bill 2018: [Seanad Bill amended by the Dáil] Report and Final Stages

Group 11 includes amendments Nos. 91, 92 and 105. They relate to judicial remedy.Amendment No. 91 will mean that in cases taken on behalf of data subjects by a not-for-profit body, organisation or association arising from an alleged infringement of the GDPR a court may grant relief by means of an injunction or declaration, or by way of compensation for material or non-material damage suffered by the data subject.

Amendment No. 92 will provide similar remedies for infringements of Part 5 of the Bill.

Amendment No. 105 which amends section 148 will mean that the leave of the court will not be required for the purpose of appealing to a higher court on a point of law.
