Senator Thomas Byrne said that before the Dunne judgment, the courts had no discretion not to order repossessions. That judgment was made in 2011. In 2009, when Fianna Fáil was in government, the Land and Conveyancing Law Reform Act was passed, but it contained no provision to prevent repossessions. The Senator has accepted that when Fianna Fáil introduced the legislation, it was its intention that the courts, when faced with an application for repossession of a family home, would grant orders.
