Section 37(1)(d) reads:

referred to in section 30(1)(d), by a person--(i) nominated under section 30(9)(a) but not appointed on foot of that nomination, or
(ii) nominated by the same body which nominated the member who occasioned the vacancy,selected by the education and training board concerned.

In terms of casual vacancies, will this provision only apply to the nominated panels that were already in existence? It would only apply to the five members and would not be open to anyone else.
