Taxi Regulation Bill 2012: Committee Stage (Resumed)

 

Government amendment No. 61: In page 57, before section 58, to insert the following new section:?PART 9 AMENDMENT OF PART 2 OF PUBLIC TRANSPORT REGULATION ACT 200958.?The Public Transport Regulation Act 2009 is amended?(a) in section 19?(i) by substituting for subsection (2) the following:?(2) (a) Where the Authority proposes to revoke a licence in accordance with subsection (1)(b), (c) or (d), it shall give notice of its intention to the licence holder and shall invite the holder to make written submissions to it within 21 days or such further period as the Authority allows. The Authority shall consider any representations duly made before deciding to revoke the licence. (b) Where having considered submissions under paragraph (a), the Authority decides that the licence should be revoked, it shall advise the holder in writing that the evocation shall have effect?(i) where the holder does not make an appeal under section 22 within the period allowed under section 22(1)(a) to make the appeal, upon the expiration of the period referred to in section 22(1)(a), or (ii) where the holder makes an appeal within the period allowed under section 22(1)(a), subject to section 22(8) in the case of a further appeal to the Circuit Court, upon the determination of the appeal or its withdrawal.?,(ii) by substituting for subsection (5) the following:?(5) A person who continues to provide a public bus passenger service in respect of which a licence has been revoked under this section and the revocation has taken effect commits an offence.?,(b) in section 22(1)(a), by inserting ?where an application has been refused? after ?transfer of a licence?, and (c) in section 24?(i) by substituting for subsection (1) the following:?(1) A person who commits an offence under section 6(2) or 19(5) is liable?(a) on summary conviction, to a class A fine, or (b) on conviction on indictment, to a fine not exceeding ยค250,000.?,(ii) in subsection (3), by inserting ?summarily? after ?prosecuted?.?.
