Despite the efforts of the Minister, Deputy Gormley, in pointing out how the policy was shifting since he came into office, An Bord Pleanála referred to policy documents from 1998, a waste management policy which was informed by the Waste Management Act 1996. This legislation enshrined incineration as a technology and identified it as an energy recovery method. This Act was introduced by a Labour Party Minister for the Environment and supported by a Fine Gael-Labour Government.
