Ciarán Lynch: I wish to clarify because this could be misconstrued.

Charities Bill 2007: Report Stage (Resumed). (5 Nov 2008)

Ciarán Lynch: If someone had an annual church gate collection they would not have to apply on the date they are having the collection in order to keep the yearly cycle going. It is no harm to clarify for the House as the Bill moves through the Stages and is enacted. The Minister is saying that there is a six to 12 month window in which one can apply for the permit.

Charities Bill 2007: Report Stage (Resumed). (5 Nov 2008)

Ciarán Lynch: I move amendment No. 90: In page 60, line 29, to delete "shall" and substitute "may". Amendment No. 91 provides that the chief superintendent concerned may refuse an application, or revoke a non-cash collection permit where he is of the opinion that collectors on behalf of the applicant have previously, or are likely to, so conduct themselves, whether by way of harassment, intimidation, or...

Charities Bill 2007: Report Stage (Resumed). (5 Nov 2008)

Ciarán Lynch: I move amendment No. 95: In page 63, between lines 9 and 10, to insert the following: "(a) The holder of a permit shall report to the relevant Chief Superintendent as to whether and to what extent the permit was availed of during the time permitted, and where a permit was not, or not fully, availed of, the Chief Superintendent may take that matter into account in determining whether to issue...

Charities Bill 2007: Report Stage (Resumed). (5 Nov 2008)

Ciarán Lynch: The core issue is that an organisation that might not use its full allocation of permit time might deliberately go out of its way not to inform the authorities of its difficulty. I would not be surprised if the Garda Síochána and officials were not aware of the problem because the type of violation is hidden. If the Minister of State were to reconsider the matter at a later stage in the...

Ciarán Lynch: I move amendment No. 99: In page 64, line 28, to delete "may" and substitute "shall".

Charities Bill 2007: Report Stage (Resumed). (5 Nov 2008)

Ciarán Lynch: It is interesting to note that the Minister of State has suggested an increase in the board's membership from nine to a potential 15, nearly double the initial figure. Three matters must be considered. When the figure was originally nine, the members were to be drawn from persons, each of whom "hold or formerly held judicial office in the Superior Courts" or "are barristers or solicitors of...

Charities Bill 2007: Report Stage (Resumed). (5 Nov 2008)

Ciarán Lynch: Given the Minister's response, I am prepared to withdraw the amendment. Also, the Minister's amendment has, to some extent, overshadowed Deputy Wall's amendment.

Charities Bill 2007: Fifth Stage (5 Nov 2008)

Ciarán Lynch: I welcome the legislation. As in the case of other legislation, this Bill was slipping through the House under the radar, the manner in which most charity is done. I believe this is informative and important legislation. As stated by Deputy Ring earlier, it is necessary that the content of this legislation be publicised and promoted. We, as Irish people, have a strong tradition of...

Order of Business (6 Nov 2008)

Ciarán Lynch: It might be a matter for the Minister for Social and Family Affairs.

Order of Business (6 Nov 2008)

Ciarán Lynch: I am aware the Ceann Comhairle already has ruled Deputy O'Dowd out of order on the issue of the appointment of family members. I suggest Members could facilitate that discussion in the debate on the social welfare Bill in respect of the family income supplement.

Financial Institutions Support Scheme. (6 Nov 2008)

Ciarán Lynch: Question 9: To ask the Minister for Finance the details of the formula used to derive the aggregate amount of the charge to banks and credit institutions covered by the credit institutions financial support scheme; and if he will make a statement on the matter. [38814/08]

Order of Business (19 Nov 2008)

Ciarán Lynch: Yesterday, the Minister for the Environment, Heritage and Local Government and the Minister of State with responsibility for housing announced a package of measures that will improve standards of rental accommodation. To what legislative framework will these measures be attached and will the Taoiseach say whether it is one item of legislation or a series? Given the Minister's comments...
