Public Accounts Committee: Business of Committee (24 Sep 2020)

Catherine Murphy: I have no issue and an update is fine, but are there boundaries with the likes of GSOC, the Director of Public Prosecutions, DPP, and others? Maybe the Comptroller and Auditor General might give us some sort of an indication on it.

Public Accounts Committee: 2017 Annual Report of the Comptroller and Auditor General and Appropriation Accounts
Vote 24 - Justice and Equality
(4 Apr 2019)

Catherine Murphy: Page 16, on Vote 24, deals with the Garda Síochána Ombudsman Commission, GSOC. There was a saving of €800,000 due to not proceeding with an investigation into wrongful cancellation of fixed charge notices. My understanding is there are queues of work for GSOC. Could those funds have been used at the time to deal with some of those queues?

Catherine Murphy: ...-ranging powers it would be overseen by a very balanced and representative board, which is vital. The Bill also provides for a basic code of service for the Garda Síochána, a breach of which would result in grounds for a complaint to GSOC. This is a key measure that greatly alters behaviour in the Garda from the top to the bottom. There need to be consequences because...

Catherine Murphy: ...amount of power. That is not what was intended by the framers of the Constitution. There was to be a separation of power between the Executive and the Oireachtas. As we saw in recent days, GSOC is supposed to report to the Oireachtas, but it was the Minister who appointed the judge and it was the Minister and the Attorney General who drew up the terms of reference. The Government is...
