Joint Oireachtas Committee on Public Service Oversight and Petitions: Security and Surveillance Issues: Minister for Justice and Equality (19 Feb 2014)

Noel Harrington: ...equipment could have been in any location within a wide radius of the Garda Síochána Ombudsman Commission's offices. Did the investigation assess other premises and buildings in the vicinity of GSOC's offices? For example, I note there is an outlet on Ormond Quay which sells surveillance equipment, metal detectors and Garda accessory equipment. Did the Minister receive any...

Joint Oireachtas Committee on Public Service Oversight and Petitions: Security and Surveillance Issues: Minister for Justice and Equality (19 Feb 2014)

Noel Harrington: I welcome the Minister and his officials. Chairman, may I raise at the outset an issue arising from last week's meeting with GSOC? I put the following question to Commissioner Simon O'Brien: "Does GSOC occupy the entire building from which it works?" and his response was that it did not, but I recall Commissioner Carmel Foley correcting that, but that does not appear on the transcript....

Joint Oireachtas Committee on Public Service Oversight and Petitions: Security and Surveillance Issues: Minister for Justice and Equality (19 Feb 2014)

Noel Harrington: I asked Commissioner O'Brien whether GSOC occupied the entire building. He said: " We occupy the entire building." This response was subsequently clarified by Commissioner Carmel Foley, but that does not appear in the transcript.

Joint Oireachtas Committee on Public Service Oversight and Petitions: Security and Surveillance Issues: Minister for Justice and Equality (19 Feb 2014)

Noel Harrington: ...are elements of conflict between the conclusions drawn by Verrimus and Rits on the technical issues that have been outlined on the three anomalies? The Garda Síochána Ombudsman Commission, GSOC, is an investigative body and the commissioners referred in their testimony to an investigation ongoing into the security breach in GSOC in regard to the report that appeared in the...

Joint Oireachtas Committee on Public Service Oversight and Petitions: Security and Surveillance Issues: Minister for Justice and Equality (19 Feb 2014)

Noel Harrington: Does the Minister consider that the appointment of the High Court judge would cause some concern or undermine the work of GSOC as an investigative commission? I believe the Minister is not satisfied with the current legislation that provides for the work of GSOC. The Minster may have answered this already but will he comment?

Joint Oireachtas Committee on Public Service Oversight and Petitions: Security and Protocol Issues: Garda Síochána Ombudsman Commission (12 Feb 2014)

Noel Harrington: The press release that the GSOC issued this week went to great lengths to exonerate An Garda Síochána, but mentioning it in the press release almost had the opposite effect. Did Mr. O'Brien consult with An Garda Síochána before he issued that press release? That is referred to in the protocols that the GSOC agreed last September.

Joint Oireachtas Committee on Public Service Oversight and Petitions: Security and Protocol Issues: Garda Síochána Ombudsman Commission (12 Feb 2014)

Noel Harrington: I thank the Chairman. I will conclude shortly. Where he believes an offence may have occurred, will Mr. O'Brien outline the next step GSOC intends to take?

Joint Oireachtas Committee on Public Service Oversight and Petitions: Security and Protocol Issues: Garda Síochána Ombudsman Commission (12 Feb 2014)

Noel Harrington: ...Graham Greene's 1949 film, "The Third Man". I say this with deference to Ms Foley. I wish to set a context in respect of some of the issues involved. What is the total staff complement within GSOC? Do all staff members come under the provisions of the Official Secrets Act? How many of GSOC's staff are seconded from An Garda Síochána? Does GSOC occupy the entire building...

Joint Oireachtas Committee on Public Service Oversight and Petitions: Security and Protocol Issues: Garda Síochána Ombudsman Commission (12 Feb 2014)

Noel Harrington: Has GSOC taken steps in this regard? Mr. O'Brien should outline the next steps.

Joint Oireachtas Committee on Public Service Oversight and Petitions: Security and Protocol Issues: Garda Síochána Ombudsman Commission (12 Feb 2014)

Noel Harrington: It is an in-house investigation. As for the equipment used, who owns the Wi-Fi device? Is it still in the possession of GSOC? Does GSOC intend to have it go under a more forensic examination to ascertain whether further evidence can be extracted from it to further its own investigations? On the second threat, members have been told that the phone instrument or the conference phone...

Joint Oireachtas Committee on Public Service Oversight and Petitions: Garda Síochána Ombudsman Commission Special Report and Annual Report 2012: Discussion with Garda Commissioner (20 Nov 2013)

Noel Harrington: ...and what the Garda Síochána deems to be relevant to an investigation. I wonder how this can be addressed in a meaningful way without mediation at High Court Justice level between the Garda Síochána Ombudsman Commission, GSOC, and An Garda Síochána in regard to what is relevant? We are not judges and cannot make decisions based on reports put before us which...
