Ceisteanna - Questions: Departmental Programmes (23 Feb 2022)

Micheál Martin: And they said it was inadvertent. It is a matter then for GSOC if it wishes to take it up, or if people wish to refer it to GSOC. That is why GSOC is there. Where we have agencies such as GSOC and others they should be used to pursue issues of this kind to get them dealt with and to get early closure in respect of such issues. We have put a lot of resources behind enforcement agencies and...

Written Answers — Department of Justice and Equality: Garda Síochána Ombudsman Commission (22 Mar 2017)

Frances Fitzgerald: The Garda Síochána Ombudsman Commission (GSOC) are investigating certain matters arising from the case referred to by the Deputy. This arises in part from the fact that my predecessor had referred aspects of this particular case to GSOC. As the Deputy is aware GSOC is an independent statutory body and the manner in which they conduct their investigation is a matter for them....

Written Answers — Department of Justice and Equality: Commissions of Investigation (15 Nov 2016)

Frances Fitzgerald: ...following the publication of the final report of the O'Higgins Commission of Investigation. Obviously I have to be careful not to say anything which might interfere with the investigation currently underway by GSOC. As the Deputy is aware, the Chairperson of GSOC wrote to me seeking access to certain records of the O’Higgins Commission of Investigation. In view of the provisions...

Written Answers — Department of Justice and Equality: Garda Síochána Ombudsman Commission Data (30 Sep 2015)

Frances Fitzgerald: As the Deputy is aware, the Garda Síochána Act 2005 established the Garda Síochána Ombudsman Commission (GSOC) to receive complaints from members of the public concerning the conduct of members of the Garda Síochána. The Act stipulates that the Ombudsman Commission is independent in the exercise of its functions. GSOC directly investigates complaints involving...

Alan Shatter: I have a final important comment. When GSOC receives the result of an investigation, that is not the end of the matter. It is open to GSOC, under statutory provisions, to request that a matter be further examined or to raise issues regarding the outcome of any such investigation. It is not that GSOC gets a result and it is the end of the matter.

(31 Mar 2022) See 2 other results from this debate

Matt Carthy: I welcome the Commissioner and his colleagues. I apologise for my absence; I was in the Dáil Chamber. GSOC will appear before us next week, but I want to get a sense from the Garda of how its co-ordination with GSOC operates in practice. Does the Garda have an assessment of the budgetary cost of its interactions with GSOC? Is that delineated in any way?

Joint Oireachtas Committee on Justice, Defence and Equality: Appointment of Member of Garda Síochána Ombudsman Commission Motion: Minister for Justice and Equality (15 Jul 2015) See 6 other results from this debate

Finian McGrath: ...Minister said there was a marked improvement in efficiency, dialogue and co-operation with An Garda Síochána. Some of the complaints that end up with the Garda Síochána Ombudsman Commission, GSOC, should be handled elsewhere as they are not on the serious side of the spectrum. Is the Minister confident that there will be better dialogue and co-operation with the...

Questions on Promised Legislation (30 May 2018)

Leo Varadkar: First, the Garda Síochána Ombudsman Commission, GSOC, is independent of the Garda and the Government. If, as a House, we do not believe GSOC is independent, we will need to have a separate debate about that matter and a much more serious one. It is my understanding GSOC intends to publish its report in the coming days. Of course, after it is published, it can be discussed-----

Written Answers — Department of Justice and Equality: Garda Síochána Ombudsman Commission Investigations (11 Jun 2019)

Charles Flanagan: ...Deputy that the person referred to had sought the setting up of an inquiry under section 109 of the Garda Síochána Act 2005 arising from his dissatisfaction with the progress of his complaint to GSOC. I examined the matter in light of the person's request and, as I am required to do under the Act, I consulted with GSOC.  Following that consultation I decided that there...

Leaders' Questions (12 Jun 2014) See 4 other results from this debate

Clare Daly: In making his last point on the public interest inquiry and GSOC's observations, the Tánaiste's has again undermined GSOC by incorrectly repeating that it had an obligation to bring it to the attention of the Garda and the Minister. Section 103 excludes GSOC from doing so in the public interest. I suggest the Tánaiste read the report again as he missed a few things in his...

Ceisteanna - Questions: Departmental Bodies (17 May 2022)

Micheál Martin: ...revert back to the Deputy. I will engage with the Minister on that. We are all looking for a comprehensively sound database in respect of the crime statistics. Deputy Daly raised the issue of GSOC and historic inquiries. The volume of cases currently being heard by GSOC is quite considerable. As I have said previously, there has to be some balance, unfortunately, in terms of the...

On 16 June 2016, having consulted with the Attorney General and having sought additional information...

Charles Flanagan: The Garda Síochána Act 2005 established GSOC to provide independent oversight of alleged misbehaviour by members of the Garda Síochána. The Act stipulates that the Ombudsman Commission is independent in the performance of its functions. I am informed by GSOC that there were 758 enquiries and investigations being undertaken at the end of May 2017. This compares with 703...

Frances Fitzgerald: GSOC is a very important body and Ms Justice Mary Ellen Ring is the chairperson. I thank her and the other commissioners for their work. It is very important that we have confidence in its work and that An Garda Síochána has confidence in it too. That means the public will have confidence as they need to know that very important role is being carried out effectively and...

Derek Nolan: We are coming to the end of a very difficult time for the policing authorities in this country, namely An Garda Síochána and the Garda Síochana Ombudsman Commission, GSOC. The last two years have been full of controversies relating to penalty points and the relationship between the gardaí and the commission, which got so strained at one point that it led to public...

I do not have enough time to go through everything but I will outline 30 bullet points as to why the Minister should resign: No. 1 - he bypassed GSOC and ignored its statutory remit and role to investigate Garda misconduct in regard to the Roma children controversy; No. 2 - in the terms of reference he set out for the Ombudsman for Children he...
