Seanad: Charities Bill 2007: Committee Stage (4 Dec 2008)

Ivana Bacik: I asked a question about that.

Seanad: Charities Bill 2007: Committee Stage (4 Dec 2008)

Ivana Bacik: In that case, could the Attorney General's advice be sought on this aspect? Will the Minister indicate whether he will consider that? We may not press these amendments if he indicates that he will consider referring back to the Attorney General, given that the Attorney General has not had an opportunity to give advice on this matter. It is a matter on which he should give advice.

Seanad: Charities Bill 2007: Committee Stage (4 Dec 2008)

Ivana Bacik: The Minister of State said, first, he will not accede to our request because the Revenue does not want it and, second, he wants to preserve the status quo. I do not accept those are valid reasons for rejecting the amendments, which are important and which would greatly enhance this welcome legislation. We cannot accept what the Minister of State said and I will press amendment No. 14 if the...

Seanad: Charities Bill 2007: Committee Stage (4 Dec 2008)

Ivana Bacik: As I have said, I would like to press my amendment No. 14 in particular to a vote but I know all these amendments are similar.

Seanad: Charities Bill 2007: Committee Stage (4 Dec 2008)

Ivana Bacik: If the Minister of State would give Members some guarantees or a rationale for this, I, like other Senators, would not press it at this stage but would reserve my position until Report Stage.

Seanad: Charities Bill 2007: Committee Stage (4 Dec 2008)

Ivana Bacik: Why?

Seanad: Charities Bill 2007: Committee Stage (4 Dec 2008)

Ivana Bacik: I support the amendment as it applies to humanism. Like Senator Norris, I believe Senator Hannigan is correct that it is important humanism would be included. In section 3, the advancement of religion is one of the charitable purposes and the Humanist Association of Ireland certainly should also be included as a charity under that heading. The Labour Party has amendment No. 13 which would...

Seanad: Charities Bill 2007: Committee Stage (4 Dec 2008)

Ivana Bacik: I too support amendment No. 13. As I said, I would like the definition of "religion" to be extended to include humanism, but it is correct to exclude what we know as cults from this definition.

Seanad: Charities Bill 2007: Committee Stage (4 Dec 2008)

Ivana Bacik: In view of the vote on amendment No. 9, which is based on the same principle, and the comments of the Minister of State, I do not propose to press amendment No. 14 at this point, although I reserve the right to do so on Report Stage.

Seanad: Order of Business (10 Dec 2008)

Ivana Bacik: I thank the Leader for his congratulations.

Seanad: Housing (Miscellaneous Provisions) Bill 2008: Report and Final Stages (10 Dec 2008)

Ivana Bacik: I move amendment No. 19: In page 17, line 26, to delete "may" and substitute "shall". This is simply to make mandatory the obligation on a housing authority to carry out a social housing assessment under section 20(3). I ask the Minister of State to accept that. It imposes an obligation rather than merely facilitating the housing authority. It is in the spirit of the Bill. We have debated...

Seanad: Housing (Miscellaneous Provisions) Bill 2008: Report and Final Stages (10 Dec 2008)

Ivana Bacik: I do not accept the Minister's response. It is important to place the obligation on the housing authority. I will not press the amendment at this Stage since we have debated it already.

Seanad: Housing (Miscellaneous Provisions) Bill 2008: Report and Final Stages (10 Dec 2008)

Ivana Bacik: I second the amendment. There was extensive debate on these three amendments on Committee Stage, as the Minister of Stage will recall. I think he indicated at that point that he would go back to the Parliamentary Counsel about the interplay between section 20(5) to which these amendments are proposed and section 35(5), which I think is now section 34(5). The amendments propose to allow...

Seanad: Housing (Miscellaneous Provisions) Bill 2008: Report and Final Stages (10 Dec 2008)

Ivana Bacik: I second the amendment.

Seanad: Housing (Miscellaneous Provisions) Bill 2008: Report and Final Stages (10 Dec 2008)

Ivana Bacik: I move amendment No. 23: In page 18, line 19, to delete "may" and substitute "shall". We debated this amendment on Committee Stage. It imposes an obligation on the Minister to make regulations in subsection (6) rather than merely providing that he or she may make regulations.

Seanad: Housing (Miscellaneous Provisions) Bill 2008: Report and Final Stages (10 Dec 2008)

Ivana Bacik: I move amendment No. 24: In page 18, line 25, to delete "need;" and substitute the following: "need. In particular housing need assessments must have regard to the need for housing of people who— (i) are homeless, (ii) are members of the Travelling Community, (iii) are living in accommodation that is unfit for human habitation or is materially unsuitable for their adequate housing, (iv) are...

Seanad: Housing (Miscellaneous Provisions) Bill 2008: Report and Final Stages (10 Dec 2008)

Ivana Bacik: I move amendment No. 25: In page 18, line 28, to delete "may" and substitute the following: "shall, within one year of the commencement of this section". This amendment was debated on Committee Stage and simply imposes an obligation on the Minister to make the regulations within one year.

Seanad: Housing (Miscellaneous Provisions) Bill 2008: Report and Final Stages (10 Dec 2008)

Ivana Bacik: In the spirit of the Bill, the amendment seeks to ensure that the regulations will be made in a timely fashion after the commencement of the Act.

Seanad: Housing (Miscellaneous Provisions) Bill 2008: Report and Final Stages (10 Dec 2008)

Ivana Bacik: I will not push the amendment.

Seanad: Housing (Miscellaneous Provisions) Bill 2008: Report and Final Stages (10 Dec 2008)

Ivana Bacik: I move amendment No. 26: In page 18, line 29, after "of" to insert "annual". While it has already been debated on Committee Stage, this important amendment seeks to ensure that needs assessments are carried out annually rather than on a tri-annual basis. It is to ensure that such assessments are done on a more up-to-date basis. As we know, conditions in the housing market change quickly and...
