Seanad: An tOrd Gnó (Atógáil) - Order of Business (Resumed) (24 Apr 2024)

Barry Ward: I want to raise a number of issues, primarily in light of the decision that was made by the Taoiseach correctly to issue an apology to the families of the Stardust victims. In that context, one issue I have raised on a number of occasions in this Chamber is the lack of action by the Government and successive Governments with regard to the victims of thalidomide, who have been waiting a much...

Seanad: Court Proceedings (Delays) Bill 2023: Committee and Remaining Stages (24 Apr 2024)

Barry Ward: The section creates the right for people to be compensated in circumstances where there is a breach of their right to have proceedings dealt with "within reasonable time". I have two questions about "reasonable time". I know that later in this section, there is an expansive definition in section 11(4) of what factors will be considered for what constitutes "reasonable time". The Bill...

Joint Oireachtas Committee on Justice, Defence and Equality: EU Regulations and Directive on International Protection, Asylum and Migration: Discussion (23 Apr 2024)

Barry Ward: In terms of implementing the pact, how much of it will be done through primary legislation and how much by secondary legislation?

Joint Oireachtas Committee on Justice, Defence and Equality: EU Regulations and Directive on International Protection, Asylum and Migration: Discussion (23 Apr 2024)

Barry Ward: Another argument-----

Joint Oireachtas Committee on Justice, Defence and Equality: EU Regulations and Directive on International Protection, Asylum and Migration: Discussion (23 Apr 2024)

Barry Ward: Another criticism I have heard on the efficiency and timelines, which are set forth in the pact, is around why we cannot do that without signing up to the pact, leaving aside the advantages of signing up to the pact. What is to stop Ireland from implementing the same timelines in dealing with applications?

Joint Oireachtas Committee on Justice, Defence and Equality: EU Regulations and Directive on International Protection, Asylum and Migration: Discussion (23 Apr 2024)

Barry Ward: I think we should opt into the pact.

Joint Oireachtas Committee on Justice, Defence and Equality: EU Regulations and Directive on International Protection, Asylum and Migration: Discussion (23 Apr 2024)

Barry Ward: By opting in, the Minister mentioned resources being provided, even leaving aside the solidarity mechanisms which are available. What additional resources would come our way and how would that assist our dealing with migration or asylum applications?

Joint Oireachtas Committee on Justice, Defence and Equality: EU Regulations and Directive on International Protection, Asylum and Migration: Discussion (23 Apr 2024)

Barry Ward: Finally, I ask about the Dublin III regulation. The Minister mentioned that it was inefficient and it is, to a large extent, broken, which many people would say. Does the Minister have any apprehension that, if it was to operate the way it was supposed to, we would be obliged, as a member of the European pact, to take a proportion of asylum seekers? The Dublin III regulation obviously...

Joint Oireachtas Committee on Justice, Defence and Equality: EU Regulations and Directive on International Protection, Asylum and Migration: Discussion (23 Apr 2024)

Barry Ward: I thank the Minister very much.

Joint Oireachtas Committee on Justice, Defence and Equality: EU Regulations and Directive on International Protection, Asylum and Migration: Discussion (23 Apr 2024)

Barry Ward: I have heard what the Minister said about it not being in our interest to go it alone and I very much agree. Some commentators on this say it will cede our sovereignty with regard to immigration and asylum issues. How does the Minister address that argument? Will she confirm that it is not the case? If it is the case, will she explain to what extent and how it is the case?

Committee on Key Issues affecting the Traveller Community: Give Travellers the Floor: Discussion (18 Apr 2024)

Barry Ward: Gabhaim buíochas leis an gCathaoirleach. I will not take her five minutes. First, I recognise the Cathaoirleach. It has been an honour to serve in the Seanad with her. She and I joined at the same time. In fact, notwithstanding her prejudice, I understand her family might have speculated about my status as a Traveller or otherwise with a name like "Ward", but I have had the...

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: If I may, may I make my contribution now as I must be elsewhere? I will be brief.

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: Sorry, I am very grateful to Senator Gallagher. I have two very quick questions. The first is on the operation of section 4(8) of the Proceeds of Crime of Act 1996, that is, the non-disposal in the circumstances where it would be against the interests of justice. Can Mr. McMeel give me an idea of how often it happens or has it ever happened?

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: Is it an operative clause then or is it just window-dressing? Surely there are cases where there are properties - Senator Ruane mentioned one to me - where somebody was left in homelessness, for example. Notwithstanding the fact that the asset might be the proceeds of crime, is it surely unjust to put somebody out on the street who has nothing to do with that criminal activity?

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: To be honest with Mr. McMeel, it does appear callous.

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: Yes, local authority tenants, in fact. Well, they would not be any more but the property was acquired from -----

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: Yes, without naming any individuals or anything like that. The person who was a subject of a CAB order had bought the property of his parents from the local authority and they were not allowed to stay there.

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: On head 5(1), where the period is changing from seven years to potentially two, does CAB have any concerns about the constitutional aspect of that or the imposition on individual property rights?

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: I thank the Chair, I appreciate being let in there.

Seanad: EU Regulations (Police Co-operation on Migrant Smuggling and Trafficking in Human Beings): Motion (11 Apr 2024)

Barry Ward: Gabhaim buíochas leis an gCathaoirleach Gníomhach. I dtús báire, ba mhaith liom mo chomhghairdeas a dhéanamh leis an Aire as an bpost atá fós aici. Ba mhaith liom freisin fáilte a fhearadh roimh an rún seo ón ngrúpa Fhine Gael. There is nothing in this motion that we should be afraid of. It makes absolute sense to opt into this...
