Committee on Key Issues affecting the Traveller Community: Give Travellers the Floor: Discussion (18 Apr 2024)

Barry Ward: Gabhaim buíochas leis an gCathaoirleach. I will not take her five minutes. First, I recognise the Cathaoirleach. It has been an honour to serve in the Seanad with her. She and I joined at the same time. In fact, notwithstanding her prejudice, I understand her family might have speculated about my status as a Traveller or otherwise with a name like "Ward", but I have had the...

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: Sorry, I am very grateful to Senator Gallagher. I have two very quick questions. The first is on the operation of section 4(8) of the Proceeds of Crime of Act 1996, that is, the non-disposal in the circumstances where it would be against the interests of justice. Can Mr. McMeel give me an idea of how often it happens or has it ever happened?

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: Is it an operative clause then or is it just window-dressing? Surely there are cases where there are properties - Senator Ruane mentioned one to me - where somebody was left in homelessness, for example. Notwithstanding the fact that the asset might be the proceeds of crime, is it surely unjust to put somebody out on the street who has nothing to do with that criminal activity?

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: To be honest with Mr. McMeel, it does appear callous.

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: Yes, local authority tenants, in fact. Well, they would not be any more but the property was acquired from -----

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: Yes, without naming any individuals or anything like that. The person who was a subject of a CAB order had bought the property of his parents from the local authority and they were not allowed to stay there.

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: On head 5(1), where the period is changing from seven years to potentially two, does CAB have any concerns about the constitutional aspect of that or the imposition on individual property rights?

Joint Oireachtas Committee on Justice, Defence and Equality: Pre-legislative Scrutiny of the Proceeds of Crime (Amendment) Bill 2024: Discussion (16 Apr 2024)

Barry Ward: I thank the Chair, I appreciate being let in there.

Seanad: EU Regulations (Police Co-operation on Migrant Smuggling and Trafficking in Human Beings): Motion (11 Apr 2024)

Barry Ward: Gabhaim buíochas leis an gCathaoirleach Gníomhach. I dtús báire, ba mhaith liom mo chomhghairdeas a dhéanamh leis an Aire as an bpost atá fós aici. Ba mhaith liom freisin fáilte a fhearadh roimh an rún seo ón ngrúpa Fhine Gael. There is nothing in this motion that we should be afraid of. It makes absolute sense to opt into this...

Seanad: An tOrd Gnó - Order of Business (28 Feb 2024)

Barry Ward: Many of our athletes are still in the qualification process for the Olympic Games in Paris this year. I wish all of them good luck and I congratulate those who have already qualified. I am thinking in particular of Jack Marley, a boxer from Monkstown, which is in my area. We do not hear enough about these athletes and what they have already achieved in qualifying for the Olympics. We also...

Seanad: An tOrd Gnó - Order of Business (22 Feb 2024)

Barry Ward: I acknowledge our friends from Estonia. In the context of our European neighbours, we have a lot to learn from Estonia, particularly its approach to digital advancements. There is a lot to be followed there in terms of developing our capacity in the digital realm. I welcome them to the Chamber this morning. I also acknowledge that today is European Day of Victims of Crime so it is very...

Seanad: European Arrest Warrant (Amendment) Bill 2022: Committee Stage (22 Feb 2024)

Barry Ward: I accept what the Minister of State is saying. The reason I tabled amendments Nos. 14 and 16, for example, regarding the deletion of reference to section 21A is that I am not sure it is wise for us to be putting into this legislation where a decision has not been made to prosecute. The de facto implication of that, and I am absolutely open to correction here, is that member states could...
