Energy (Windfall Gains in the Energy Sector) (Cap on Market Revenues) Bill 2023: Report and Final Stages (18 Oct 2023)

Jennifer Whitmore: Every element of this Bill has come from this EU directive. We are duplicating and repeating what is in that EU directive to a great extent. I do not understand why the ring-fencing and targeting components of this have not been included in the Bill. It just does not make sense to me that all the other elements from the EU directive are included but not that component.

Energy (Windfall Gains in the Energy Sector) (Cap on Market Revenues) Bill 2023: Report and Final Stages (18 Oct 2023)

Jennifer Whitmore: While the amendment extends the relevant period, this relates to hedging arrangements. The question is whether the extension of the relevant period as regards hedging arrangements was part of the discussions on the legal considerations.
