Written Answers — Department of Justice and Equality: Departmental Strategies (20 Mar 2024)

Francis Noel Duffy: 824. To ask the Tánaiste and Minister for Justice and Equality when she plans to publish the regulations under section 18(7) and 19(9) of the Multi-Unit Developments Act 2011, which were proposed for publication in Q4 of 2022 in Housing for All (actions 25.10 and 25.11). Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (20 Mar 2024)

Francis Noel Duffy: I think the problem with this is that wording. Those four words are leaving the door open. Something should be changed with those words because if you leave them there, it means an authority can be impractical. That is what it can do. That is what the law will say. If this local authority wants to be impractical, it can be because that wording has been left there to say that, and...

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (20 Mar 2024)

Francis Noel Duffy: My amendment No. 334 is on the obligation to prepare a strategy for sustainable development and regeneration. Section 42 states a planning authority shall prepare a strategy for the sustainable development and regeneration of the functional area of the planning authority and that "the strategy shall set out objectives relating to the prioritisation of and measures to facilitate compact urban...

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (20 Mar 2024)

Francis Noel Duffy: That is fair enough.

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (20 Mar 2024)

Francis Noel Duffy: I have one other point. If you take it out or put "urban" in after "rural", you cover rural and urban but it is being left out.

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (20 Mar 2024)

Francis Noel Duffy: In that context, where is sustainable urban development? It is not there; that is the point. The Bill states it is only rural sustainable development and not urban. We are not even putting in "regeneration" regarding compact urban development. Regeneration means you do not just flatten everything; you try to work with what is there.

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (20 Mar 2024)

Francis Noel Duffy: This amendment propose to delete some wording. Subsection 40(7)(s) states: In making or varying a development plan, a planning authority shall have regard to the development plans of adjoining planning authorities and shall, insofar as is practicable, coordinate the objectives in the development plan with the objectives in the plans of those authorities. We are proposing to delete...

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (19 Mar 2024)

Francis Noel Duffy: I move amendment No. 229: In page 68, line 28, to delete “and". I will withdraw this amendment, as I would like to table it again.

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (19 Mar 2024)

Francis Noel Duffy: This is in some way similar to the national planning framework where there were six provisions. Five of those were progressive and expansive in the context of the economy and the urban construct. I agree with that and support that we expand and move forward. However, the environmental side in this legislation is again about preserving and protecting, which means to stand still. If...

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (19 Mar 2024)

Francis Noel Duffy: We need to be mindful that the Government is moving forward with everything else in the Bill and the environment is standing still. By preserving it as opposed to some element of enhancement, it is effectively regressive.

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (19 Mar 2024)

Francis Noel Duffy: I move amendment No. 240: In page 70, line 5, to delete “and protection” and substitute “, protection and enhancement”. I will withdraw the amendment with a view to bringing it back on Report Stage.

Select Committee on Housing, Planning and Local Government: Planning and Development Bill 2023: Committee Stage (Resumed) (6 Mar 2024)

Francis Noel Duffy: I move amendment No. 149: In page 61, line 19, after “conservation” to insert “and enhancement”.

An tOrd Gnó - Order of Business (5 Mar 2024)

Francis Noel Duffy: For thousands of householders and organisations like the Construction Defects Alliance and the Apartment Owners Network, which have campaigned for years, the announcement in January for the interim fire redress scheme brought immense relief. Like many households that are facing water ingress issues and structural damage, we await the legislation and full redress scheme on which I would...

Written Answers — Department of Children, Equality, Disability, Integration and Youth: Youth Work Supports (29 Feb 2024)

Francis Noel Duffy: 86. To ask the Minister for Children, Equality, Disability, Integration and Youth when the new youth employability funding scheme will be announced; how much has been set aside; the application criteria; when he expects to announce recipients; and if he will make a statement on the matter. [9194/24]
