Joint Oireachtas Committee on Agriculture, Food and the Marine: Compliance with the Nitrates Directive and Implications for Ireland: Discussion (Resumed) (28 Feb 2024)

Victor Boyhan: I will turn to the ICSA and Mr. McNamara. What is very important, and it was highlighted in the ICSA submission, is that total nitrogen sales went down to 280,000 tonnes in 2023, which beat the climate action plan targets for 2030. That is a profound statement. It is very interesting. It is a fact; I checked it today. According to the ICSA, "Total nitrogen sales were down to 280,000...

Joint Oireachtas Committee on Agriculture, Food and the Marine: Compliance with the Nitrates Directive and Implications for Ireland: Discussion (Resumed) (28 Feb 2024)

Victor Boyhan: I fully understand the issue. I am asking what the ICSA is proposing for how we address it.

Joint Oireachtas Committee on Agriculture, Food and the Marine: Compliance with the Nitrates Directive and Implications for Ireland: Discussion (Resumed) (28 Feb 2024)

Victor Boyhan: I fully agree. I shall now turn to Mr. Feeney from ACA. The fast-tracking of planning is a recurring theme. Mr. Feeney might touch on fast-tracked planning and TAMS applications for slurry storage on farms. The VAT reclaim facility he talked about makes absolute sense. How is the ACA running its campaign in conjunction with other farm organisations to drive the importance of this? It...

Seanad: An tOrd Gnó - Order of Business (27 Feb 2024)

Victor Boyhan: I welcome the news today that the Minister, Deputy O'Gorman, will publish the opening of the mother and baby institutions payment scheme, which has approval by Cabinet. We now know that this scheme will go live on 20 March 2024. It has been a long time coming and many people have been waiting. I have personally been involved in this issue for years. I have had personal experience of it....

Seanad: Employment Permits Bill 2022: Second Stage (27 Feb 2024)

Victor Boyhan: I welcome the Minister of State. The purpose of the Bill is to consolidate and update the legislative provisions that regulate the employment permit scheme. The 2018 review of economic migration policy, of which the Minister of State is aware, endorsed the robust fundamental structure of the existing system. However, it went on to recommend that legislation should be initiated. I take it...

Seanad: An tOrd Gnó - Order of Business (22 Feb 2024)

Victor Boyhan: I welcome the ambassador and our other guests. In particular, I welcome former Senator Eugene Regan to the Chamber. He is a friend and colleague of mine. I collaborated politically with him at local and national levels. It is great to see him here in this Chamber of which he was once a Member. I wish to raise the issue of the farmers' charter of rights. The Leader will be aware of the...

Seanad: An tOrd Gnó - Order of Business (22 Feb 2024)

Victor Boyhan: Running around the park.

Joint Oireachtas Committee on Agriculture, Food and the Marine: General Scheme of the Agriculture Appeals (Amendment) Bill 2024: Discussion (22 Feb 2024)

Victor Boyhan: I welcome the farming representatives bodies. They are up bright and early and I know they have other things to do. It is good to see them here early. We have read all of the submissions. They are circulated to us in advance and we consider them in detail, individually and collectively. As the Cathaoirleach said, the Minister will come before the committee next week. Programme for...

Seanad: Nithe i dtosach suíonna - Commencement Matters: Health Services (21 Feb 2024)

Victor Boyhan: I am particularly pleased to see the Minister of State, Deputy Rabbitte, arriving in the Seanad Chamber. She is directly responsible for the disability sector. It is always great when the line Minister with responsibility, with knowledge, with expertise and with her finger on the pulse in terms of the policy comes to the House. I am not so sure that she has her finger on the purse but she...

Seanad: Nithe i dtosach suíonna - Commencement Matters: Health Services (21 Feb 2024)

Victor Boyhan: Sending an email is very different to looking someone in the eye.

Seanad: Nithe i dtosach suíonna - Commencement Matters: Health Services (21 Feb 2024)

Victor Boyhan: The Minister of State said she was measured in her words and so am I. I have correspondence in front of me that I could have read into the record but it would not be appropriate because it is sensitive.

Seanad: Nithe i dtosach suíonna - Commencement Matters: Health Services (21 Feb 2024)

Victor Boyhan: We know that EY has completed a report into St. John of God Community Services on the financial deficit and has confirmed that €27.9 million - let us be precise - is the accumulated deficit as a result of the SLA for St. John of God Community Services. I wish the Minister of State well and I wish everyone well. This is a time of working together. At the end of the day the focus...

Seanad: An tOrd Gnó - Order of Business (21 Feb 2024)

Victor Boyhan: I want to welcome the visiting delegation from Canada. You are most welcome to Seanad Éireann. I also want to join with the Cathaoirleach and the Leader of the House in paying tribute to Michael O'Regan and expressing sympathy to his family. He was a remarkable man. In many ways, when I think of John McGahern and his readings I also think of Michael O'Regan. He was a man of the...

Seanad: Local Government (Mayor of Limerick) and Miscellaneous Provisions Bill 2023: Report and Final Stages (21 Feb 2024)

Victor Boyhan: I support the Minister in respect of these three amendments. What he is trying to do with regard to the LDA is significant, particularly in Limerick, but also everywhere else. The Bill is about Limerick, however, and I wish to focus on that. It is clear the LDA has a significant amount of work to do. We need to support and assist it. There will come a time when we have to make a judgment...

Seanad: Local Government (Mayor of Limerick) and Miscellaneous Provisions Bill 2023: Report and Final Stages (21 Feb 2024)

Victor Boyhan: I move amendment No. 4: In page 13, between lines 17 and 18, to insert the following: “(3) In conducting a review under this section, the Minister shall examine the manner in which the powers afforded to the elected council intersect with those of the Mayor and shall look to ways in which additional reserved powers of the elected council could be designated.”.

Seanad: Local Government (Mayor of Limerick) and Miscellaneous Provisions Bill 2023: Report and Final Stages (21 Feb 2024)

Victor Boyhan: I have been asked by Senator Higgins to move her amendments. I have notified the Clerk of the Seanad and the Acting Chairperson, Senator Kyne, of that request. I will keep my remarks tight because I am conscious everyone wants to get moving on it. Amendment No. 4 seeks to address an issue of long-standing concern, namely, the power afforded to local councillors. It is well documented that...

Seanad: Local Government (Mayor of Limerick) and Miscellaneous Provisions Bill 2023: Report and Final Stages (21 Feb 2024)

Victor Boyhan: I move amendment No. 5: In page 14, between lines 25 and 26, to insert the following: “(3) Functions conferred by or under any enactment specified inPart 2of Schedule 1may be removed from that Part and thus conferred on the Mayor by resolution of the elected council, with such a resolution requiring a two-thirds majority.”.

Seanad: Local Government (Mayor of Limerick) and Miscellaneous Provisions Bill 2023: Report and Final Stages (21 Feb 2024)

Victor Boyhan: I move amendment No. 7: In page 17, between lines 32 and 33, to insert the following: “(3) The Mayor shall be accountable to the elected members of Limerick City and County Council in the performance of his or her functions, unless otherwise specified in this or another enactment.”

Seanad: Local Government (Mayor of Limerick) and Miscellaneous Provisions Bill 2023: Report and Final Stages (21 Feb 2024)

Victor Boyhan: Amendment No. 9 would provide for notification of both delegations and revocations of delegations from the mayor to the director general to be given to the elected council. This reflects the engagement the Minister of State had on Committee Stage and I thank him for reflecting on those concerns for his good colleague, Senator Cummins, and for Senator Higgins. I am happy to support that.

Seanad: Local Government (Mayor of Limerick) and Miscellaneous Provisions Bill 2023: Report and Final Stages (21 Feb 2024)

Victor Boyhan: I will speak to amendment No. 11. This is a Government amendment inserting the definition of climate action into the Bill, about which the Minister of State had much discussion with Senator Higgins. I thank him and Senator Higgins also wants to thank him for engaging with her in the House on this matter. She is pleased with his response and she asked me to convey that. I propose to...
