Seanad: Appointment of Receivers: Motion (6 May 2015)

Aideen Hayden: On a positive note, I welcome the commitment of the Minister for the Environment, Community and Local Government, Deputy Alan Kelly, to amend the Residential Tenancies Act 2004; in other words, all of the rights a tenant has under that Act 2004, including being given adequate notice, having a property maintained and a deposit returned, would be seen as the obligations of a receiver appointed...

Seanad: Order of Business (5 May 2015)

Aideen Hayden: I agree with my colleague on the announcement today by the Minister, Deputy Kelly, relating to the 1,700 additional social housing units to be delivered over the next two and a half to three years. Nobody will pretend that this is the be all and end all but it is a beginning and other announcements on other issues will be forthcoming. However, the Senator also makes a very important point...

Joint Oireachtas Committee on European Union Affairs: European Semester - Draft National Reform Programme 2015: Discussion (23 Apr 2015)

Aideen Hayden: I thank the witnesses for their presentations. I have comments and observations on all of them, maybe not in logical order but in the order of the presentations. The witnesses spoke about the whole-of-government approach including national, regional and local government as well as agencies and key stakeholders. Have we ever really achieved regional government? It has been on the cards on...

Seanad: Order of Business (23 Apr 2015)

Aideen Hayden: My apologies. I did not see the Leas-Chathaoirleach indicating towards me.

Seanad: Order of Business (23 Apr 2015)

Aideen Hayden: I had a guest in the Visitors Gallery and beg the Leas-Chathaorleach's pardon. I wish to make a contribution on the issue of the engagement with AIB yesterday. A number of speakers have mentioned it and the positive outcome that it is willing to look at variable interest rates in the near future, which is to be welcomed. Despite the nation's shares in AIB, the fact remains that even though...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Overview of the Banking Sector in Ireland: Allied Irish Banks (22 Apr 2015)

Aideen Hayden: I welcome the delegates in what must be their fifth or sixth time in front of the committee. It is interesting to look at how the horizon has changed since we first started this process. I notice that, even though the figures are still quite low, the level of repossessions, including voluntary surrenders, has gone up substantially in the past few years. I get the impression that we...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Overview of the Banking Sector in Ireland: Allied Irish Banks (22 Apr 2015)

Aideen Hayden: What figure would hold true?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Overview of the Banking Sector in Ireland: Allied Irish Banks (22 Apr 2015)

Aideen Hayden: Mr. O'Connor cannot tell us what percentage of cases concluded with, say, a voluntary surrender, where somebody is in such a level of deep distress that he or she is willing to hand back the keys, qualify for a write-down. He cannot give any indication of how many cases there are in which the bank offers a write-down.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Overview of the Banking Sector in Ireland: Allied Irish Banks (22 Apr 2015)

Aideen Hayden: The write-down could be 100%, 40%, 60% or any figure.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Overview of the Banking Sector in Ireland: Allied Irish Banks (22 Apr 2015)

Aideen Hayden: I do understand that, but it would be useful to have an average figure for the cases the bank has concluded. It looks like it has offered a write-down in approximately 41% of cases. Nearly 10,000 of the bank's buy-to-let loans are in arrears for more than 90 days. In Question No. 57 it is stated the bank appoints receivers for buy-to-let properties in certain circumstances and honours...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Overview of the Banking Sector in Ireland: Allied Irish Banks (22 Apr 2015)

Aideen Hayden: What about communication with the tenant? We see situations where tenants come home knowing nothing about what is happening.

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Overview of the Banking Sector in Ireland: Allied Irish Banks (22 Apr 2015)

Aideen Hayden: Does Mr. O'Connor believe an instruction from the Central Bank, similar to the code of conduct on mortgage arrears for tenants, would be useful to establish commonality across lending institutions?

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Overview of the Banking Sector in Ireland: Allied Irish Banks (22 Apr 2015)

Aideen Hayden: I was struck by Mr. O'Connor's comments on whether the mortgage arrears resolution targets had caused the bank to engage more forcefully with some borrowers than it might otherwise have done. I was also struck by his comment on the use of legal action to bring reluctant borrowers to the table. I want to ask Mr. Duffy a further question. There is a narrative that were it not for the courts,...

Seanad: National Council for Special Education Inclusion Support Services: Statements (22 Apr 2015)

Aideen Hayden: I welcome the Minister to the House. I congratulate her on the announcement of the new inclusion support service which is under the management of the National Council for Special Education. The move is important because it will improve the delivery of educational services to children with special educational needs. By incorporating these services into the NCSE, there will be more cohesion...

Seanad: National Council for Special Education Inclusion Support Services: Statements (22 Apr 2015)

Aideen Hayden: It is essential that resources go where they are needed because children who get the full support they need will flourish and reach their full potential. A resource allocation model which allocates on the basis of the individual needs of the child will put the minds of parents at ease because they will know their children are being fairly treated. As any parent knows, we have the highest...

Seanad: Public Services and Procurement (Social Value) Bill 2015: Second Stage (22 Apr 2015)

Aideen Hayden: I welcome the Minister of State. I agree with most of the comments on the Bill made by Senator Darragh O'Brien and I am pleased the Government does not intend to oppose it.We all agree that public expenditure is critical to the national economy. A recent report by the Office of Government Procurement entitled, Public Service Spend and Tendering Analysis for 2013, stated: Prior to the...

Joint Oireachtas Committee on European Union Affairs: Possible Exit of UK from European Union: Discussion (Resumed) (16 Apr 2015)

Aideen Hayden: I thank Professor Todd for her paper. As the Chair and other members have said, we have met with a number of people around this issue. Views have varied, not so much on the question of whether BrExit would be a good thing for Ireland and Northern Irish relations, but more in terms of what could, should, might or might not be done, whether there is any point doing anything and whether this...

Seanad: Order of Business (16 Apr 2015)

Aideen Hayden: I agree with Senator Sean D. Barrett and, like all of us here, extend our sympathy to the Buckley family in Cork on the sad news that the remains found in Glasgow are most likely those of Karen Buckley. I was somewhat surprised to hear that family and friends are engaging in a fund-raising campaign to fund the family. At a time like this, money should not be an issue. I would like the Leader...

Seanad: Valuation (Amendment) (No. 2) Bill 2012: [Seanad Bill amended by the Dáil] Report and Final Stages (16 Apr 2015)

Aideen Hayden: I congratulate the Minister of State on bringing this Bill through the House. When I worked as a solicitor, valuation was always a contentious area. This legislation will bring valuations into the 21st century. It is important to bear in mind that it allows individual occupiers the opportunity to engage in the process in a way they could not before. It is also important to remember that...

Joint Oireachtas Committee on Finance, Public Expenditure and Reform: Flood Risk Insurance Cover: Discussion (15 Apr 2015)

Aideen Hayden: Given that we have covered much ground, I will recap some of it. Is Mr. Owens of the opinion, based on the best available knowledge, that Cork is adequately covered in terms of flood defences by the OPW's work?
