Joint Oireachtas Committee on Environment, Culture and the Gaeltacht: Decision-Making Processes: Discussion with An Bord Pleanála (9 Oct 2012)

Michelle Mulherin: My next point might not be relevant, given the fact that not as many planning applications are in the system. The board moves the goalposts when a decision on an application is being appealed. The board tries to redesign the scheme. In my town, the board liaised directly with applicants concerning certain housing developments instead of judging what was before it. This practice is not...

Joint Oireachtas Committee on Environment, Culture and the Gaeltacht: Decision-Making Processes: Discussion with An Bord Pleanála (9 Oct 2012)

Michelle Mulherin: Is that list just for strategic infrastructure applications?

Joint Oireachtas Committee on Environment, Culture and the Gaeltacht: Decision-Making Processes: Discussion with An Bord Pleanála (9 Oct 2012)

Michelle Mulherin: Dr. Kelly responded to my question relating to the board's liaison with applicants directly and she referred to third parties who have made objections or submissions being notified if there is a redesign of a development. However, there are still interested parties who would not be notified. In my experience, adjoining landowners who had no objection to an initial application as it was...

Joint Oireachtas Committee on Environment, Culture and the Gaeltacht: Decision-Making Processes: Discussion with An Bord Pleanála (9 Oct 2012)

Michelle Mulherin: The difficulty there is that the board has already made a decision as to whether it is a material change. It is entitled to do that, but it puts the landowner out of the loop. The board might decide it is not material but it could be argued that it is material and the landowner does not have the benefit of any notification.

Joint Oireachtas Committee on Environment, Culture and the Gaeltacht: EU Fuel Quality Directive: Discussion with Canada-Europe Parliamentary Association (9 Oct 2012)

Michelle Mulherin: I welcome the delegation. Bienvenue. If I understood Senator Fraser correctly, she explained that the full set of criteria is not being applied to Canada and it is not being considered in the same fashion and subject to the same criteria as Russia and Nigeria, the examples she cited. That sounds fairly straightforward. What is the answer Canada is being given? Why is this not the case?

Joint Oireachtas Committee on Environment, Culture and the Gaeltacht: EU Fuel Quality Directive: Discussion with Canada-Europe Parliamentary Association (9 Oct 2012)

Michelle Mulherin: That is fair enough. That message is fairly clear. The delegation is making its case to the Oireachtas Joint Committee on the Environment, Culture and the Gaeltacht and I am sure there is a case being made at many levels, but it is a fairly basic question. Obviously, Europe is not ignoring the case the delegation has made here, which is that they wish to be treated equally. What is its...

Agriculture: Motion (Resumed) [Private Members] (10 Oct 2012)

Michelle Mulherin: I would like to speak about the issue of land mobility, which is a precursor to discussions on payments and our targets under Harvest 2020. In years gone by, I attended many auctions in counties Mayo and Sligo in my capacity as a young solicitor. I encountered a well-established auctioneer who followed a particular routine and ritual at the beginning of every auction. When he was selling...
