Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)

Colm Keaveney: Section 9 provides that two psychiatrists may find that a woman's life is at risk from suicide and an abortion is required as a treatment. That standard seems to exceed the standard provided in the Mental Health Act. Will the Minister indicate how the Bill will be compatible with the Mental Health Act? Will he assure us, in light of his public utterance that the section will only apply to...

Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)

Colm Keaveney: I agree with the two previous speakers. There is no doubt that irrespective of one's position on the overall debate or the substantive issues, the proposal in section 22 is completely unacceptable to the majority of people in society who would have grave concerns that the scale of the penalties envisaged in the Bill would apply to a woman in this situation. I appeal to the Minister to look...

Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)

Colm Keaveney: On the discussion on the amendment on the obstruction of a staff member carrying out a function with respect to a termination, the Minister of State arrived at a position where consideration was given to a six-month sentence. If we were to accept the logic of the Minister of State, Deputy Alex White, how could we secure the position stipulating a potential sentence of 14 years? I fully...

Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)

Colm Keaveney: The Minister is prepared to provide for a penalty of six months for a public service worker who knowingly obstructs a procedure, as described earlier, in the unforeseen circumstance that there is destruction of the life of the unborn. Why would he provide for a penalty of six months on that basis when, under his own interpretation of section 22, he is prepared to imprison a woman for 14 years?

Committee on Health and Children: Select Sub-Committee on Health: Protection of Life During Pregnancy Bill 2013: Committee Stage (Resumed) (3 Jul 2013)

Colm Keaveney: The Minister of State is shaking his head himself.

Protection of Life During Pregnancy Bill 2013: Report Stage (Resumed) (10 Jul 2013)

Colm Keaveney: I am speaking to amendment No. 58. Many parts of the Bill are to be welcomed in that they provide legal clarity for medical professionals when they are faced with a situation in which a woman's life is at risk and where action is necessary to save her life that may result, as an unintended consequence, in the death of the unborn. The Bill, however, contains some flaws and once again, as I...

Protection of Life During Pregnancy Bill 2013: Report Stage (Resumed) (10 Jul 2013)

Colm Keaveney: One could argue that in 20 years time many of us will regret supporting or rejecting the Bill. We could look back and feel guilty or somewhat foolish. As legislators, it is our responsibility to reconcile both sides of this debate. The rhetoric that has been deployed by some people in this debate has been somewhat dishonest. It is not a fair representation when an opinion poll asks if...

Protection of Life During Pregnancy Bill 2013: Report Stage (Resumed) (11 Jul 2013)

Colm Keaveney: I am speaking on amendments Nos. 153 and 157. I have previously pointed out that neither side of the debate is prepared to engage with the arguments of the other side, preferring instead to deal in caricatures. This is a dialogue that has emerged over the past several weeks, with very few people listening. Section 22 of the Bill is a case in point. It has been argued that the 14-year...

Protection of Life During Pregnancy Bill 2013: Report Stage (Resumed) (11 Jul 2013)

Colm Keaveney: Pardon.

Protection of Life During Pregnancy Bill 2013: Report Stage (Resumed) (11 Jul 2013)

Colm Keaveney: Ms X will be 35 years old this year. She was 14 years old when she found herself in this situation. The notion was expressed to other Deputies, in particular Deputy Áine Collins, that this proposal would be absolutely unacceptable. It is clear across the House that there is a need for compassion from the Government in looking at an amendment in this area. I ask the Minister to look...

Protection of Life During Pregnancy Bill 2013: Report Stage (Resumed) and Final Stage (11 Jul 2013)

Colm Keaveney: I move amendment No. 157:In page 18, between lines 2 and 3, to insert the following:“(5) For the avoidance of doubt, it is hereby declared that subsection (1) shall not apply in relation to a pregnant woman availing of any medical procedure in the course of which, or as a result of which, an unborn human life is ended.”.
