Seán Conlan: The reason for the amendment is explicitly to limit the power to create regulation and to ensure that it complies with Article 40, 3.3o of the Constitution. I have already forwarded proposed amendments to the Minister, so he will be aware of my amendment, but it is important to ensure we comply with Article 40.3.3o of the Constitution.

Seán Conlan: I know, but I want to ask about the institutions. I listened very carefully to what the Minister said on Second Stage about ensuring that private clinics could not be included in the Schedule. I am concerned about section 38 of the Health Act 2004. If that last part of section 3(1) was excluded from the Bill under discussion, that would mean that no future Minister could change the Schedule.
