Seanad: Forestry Bill 2013: Committee Stage (9 Oct 2014)

Tom Shehan: Amendments Nos. 1, 2, 4 and 38 are related and may be discussed together by agreement. Is that agreed? Agreed.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (Resumed) (8 Oct 2014)

Tom Shehan: In the interests of being prudent, if there are further grounds for appeal to be agreed, could they not be dealt with in an addendum to the Bill later?

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (Resumed) (8 Oct 2014)

Tom Shehan: My understanding is that it will be useful with outsourcing and so on. Outsourcing, I imagine, will come up for tender every few years, and the buck must stop somewhere. I am surprised that Senator Byrne cannot acknowledge that for what it is.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (Resumed) (8 Oct 2014)

Tom Shehan: Yes, but that would be my understanding of it.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (Resumed) (8 Oct 2014)

Tom Shehan: When there is outsourcing the buck must stop somewhere, so I think this is a prudent measure.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (Resumed) (8 Oct 2014)

Tom Shehan: When we finished up on this previously, we were discussing self-assessment. While self-assessment is a laudable quick fix for rates, I could not trust myself to provide a self-assessment regarding rates. I imagine the Valuation Office might suggest 5X whereas I might suggest 2X.

Seanad: Order of Business (8 Oct 2014)

Tom Shehan: I rise this morning to raise an issue that is coming down the track and which could cause serious problems, that is our immigration policy on which a debate is warranted in the very near future. Statistics from the Department of Finance and elsewhere show that the country is on an upward swing. There is an old saying that a rising tide lifts all boats. I hope that on foot of the...

Seanad: Order of Business (8 Oct 2014)

Tom Shehan: We do not have the capacity in our education system, health system and housing supply. I urge the Leader to arrange a debate as soon as possible. Perhaps my thought structure or approach is simplistic, but a certain reservation is needed in this area which calls for a debate.

Seanad: Freedom of Information Bill 2013: Report and Final Stages (2 Oct 2014)

Tom Shehan: I congratulate the Minister on this legislation and on the efficiency with which it was dealt. I hope that it does not become a directory for cranks and that it will run well in parallel with the Data Protection Act.

Seanad: Freedom of Information Bill 2013: Report and Final Stages (2 Oct 2014)

Tom Shehan: Dé Máirt seo chugainn ar 2.30 p.m.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (1 Oct 2014)

Tom Shehan: With the greatest respect, I would not trust myself to put forward my self-assessment on rates as I know what it would amount to. The Senator is bringing the war into this House. It was always intended that the occupier would have more input in the process, as was the case in earlier sections. Profitability, turnover, ability to pay and economic developments on one or other side of town...

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (1 Oct 2014)

Tom Shehan: The Senator has one at home; just not with him.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (1 Oct 2014)

Tom Shehan: There is plenty of money in County Meath.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (1 Oct 2014)

Tom Shehan: In regard to the ability to pay and the calculation of rates, a supermarket comprising 4,000 sq. ft. with 20 staff, a turnover of €2 million, gross profit of 10% and net profit of 4%, can be levied with a rate of €8,000 per annum. On the other hand, a professional operating out of two rooms with a turnover of €1.5 million per annum might pay €300. I have long...

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (1 Oct 2014)

Tom Shehan: I apologise; I had meant to speak about profitability rather than turnover.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (1 Oct 2014)

Tom Shehan: I have one query on the amendment.

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (1 Oct 2014)

Tom Shehan: Beidh mé gairid. Hypothetically, if a property of 3,000 sq. ft. is subdivided into two commercial units of 1,000 sq. ft. leaving one third unused, would the two properties pay the full rate on the full valuation of the 3,000 sq. ft. unit?

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (1 Oct 2014)

Tom Shehan: Not really. The valuation manager has the ability to issue a certificate. As I said, the 3,000 sq. ft. unit would be divided into two units which would account for only 2,000 sq. ft. of the former property. Would the total rates on the two properties of 1,000 sq. ft. each be the same as that charged on the 3,000 sq. ft. property?

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (1 Oct 2014)

Tom Shehan: I agree with Senator Byrne on this matter. What is being provided is that the valuation manager may correct any error, technical or otherwise. At the end of the day, who would have overall responsibility in this regard? Would it be the valuation manager or the commissioner? We have seen in recent times where an error was made in respect of which the commissioner had to accept...

Seanad: Valuation (Amendment) (No. 2) Bill 2012: Committee Stage (1 Oct 2014)

Tom Shehan: Ultimately, who would be responsible for the error? Would it be the commissioner or the valuation manager?
