Criminal Justice Bill 2004: Report Stage (Resumed). (28 Jun 2006)

Gerard Murphy: I support Deputy Howlin to a certain extent. We need to consider what will happen in court if the officer who was responsible for issuing the certificate in the first place is not capable of indicating to the court the conclusions he reached on foot of the investigation he pursued up to that point. It seems that it has been decided to deal with the issue rather than to act in a justifiable...

Criminal Justice Bill 2004: Report Stage (Resumed). (28 Jun 2006)

Criminal Justice Bill 2004: Report Stage (Resumed). (28 Jun 2006)

Gerard Murphy: If the Minister is happy that the day and time of expiry will appear on every warrant, that is acceptable. However, as we all know, if a warrant is served after the expiry date, the evidence recovered is not admissible in court. That has very serious consequences and we cannot afford to have uncertainty about this issue. If it should be stated in law, that should be done.
