Seanad: Criminal Law (Sexual Offences) Bill 2015: Report and Final Stages (21 Jan 2016)

Paschal Mooney: I did not want to distract the Minister.

Seanad: Criminal Law (Sexual Offences) Bill 2015: Report and Final Stages (21 Jan 2016)

Paschal Mooney: Subsection (1) of the proposed section 21 refers to a person who engages in a sexual act with a protected person knowing that that person is a protected person and subsection (2) refers to a person who invites, induces etc. a protected person knowing that that person is a protected person. The reason I raise this issue is that a case has finished in the courts where an unfortunate victim of...

Seanad: Criminal Law (Sexual Offences) Bill 2015: Report and Final Stages (21 Jan 2016)

Paschal Mooney: I was only just curious. It is a minor detail as to why if the language says they have to know, whereas in this instance it did not matter, it was irrelevant whether he knew. The actual act was a criminal offence and the judge found accordingly and the convicted person is awaiting sentence. Let us see what happens.

Seanad: Criminal Law (Sexual Offences) Bill 2015: Report and Final Stages (21 Jan 2016)

Paschal Mooney: I second the amendment. The Cathaoirleach will forgive me for welcoming a group from counties Westmeath and Offaly, including some personal friends, who are here-----

Seanad: Criminal Law (Sexual Offences) Bill 2015: Report and Final Stages (21 Jan 2016)

Paschal Mooney: -----and from Longford, as well, of course. I am thinking of the Longford-Westmeath constituency perhaps more than anything else. As I say, we know some of the visitors in the Visitors Gallery and hope they are enjoying their tour. On my party's amendment on disclosure, amendment No. 41, as I interpret it this goes fundamentally to the protection of a complainant. If one can envisage a...

Paschal Mooney: What about the fleet?

Joint Oireachtas Committee on Transport and Communications: Bus Services: Bus Éireann and the National Transport Authority (20 Jan 2016)

Paschal Mooney: I thank Mr. Nolan.

Joint Oireachtas Committee on Transport and Communications: Bus Services: Bus Éireann and the National Transport Authority (20 Jan 2016)

Paschal Mooney: Deputy Fitzmaurice raised the issue of gas-fuelled vehicles which I raise in the context of Bus Éireann's commitment to examine ways to reduce costs. An old chestnut is the reason for using large coaches on some routes in rural areas instead of using smaller buses. Does Bus Éireann have smaller buses than the 45 seaters? There is a service that goes from Cavan through Leitrim...

Joint Oireachtas Committee on Transport and Communications: Bus Services: Bus Éireann and the National Transport Authority (20 Jan 2016)

Paschal Mooney: Is Bus Éireann VAT exempt?

Joint Oireachtas Committee on Transport and Communications: Bus Services: Bus Éireann and the National Transport Authority (20 Jan 2016)

Paschal Mooney: VAT is included in Bus Éireann's fuel cost.

Joint Oireachtas Committee on Transport and Communications: Bus Services: Bus Éireann and the National Transport Authority (20 Jan 2016)

Paschal Mooney: So the company cannot claim back the VAT.

Joint Oireachtas Committee on Transport and Communications: Bus Services: Bus Éireann and the National Transport Authority (20 Jan 2016)

Paschal Mooney: Would Mr. Creegan provide the committee with a copy of those guidelines?

Joint Oireachtas Committee on Transport and Communications: Bus Services: Bus Éireann and the National Transport Authority (20 Jan 2016)

Paschal Mooney: I agree, but I know of a case of a private operator who picked up a girl with special needs at a traditional bus stop, a place where the bus stopped when I was at school, and the private operator has had to stop picking her up because the council said it was too dangerous, even though it was a traditional bus stop. The sooner the NTA does this-----

Seanad: Order of Business (20 Jan 2016)

Paschal Mooney: If there is one criticism that could be legitimately levelled at the Fianna Fáil-Progressive Democrats Administration up to 2007, it was that it significantly narrowed the tax base by significant reductions in taxation and hugely significant increases in social welfare payments. Narrowing the tax base and taking so many people out of it, even at a time of boom, came back to haunt that...

Seanad: Flooding: Statements (20 Jan 2016)

Paschal Mooney: I welcome the Minister of State to the House. I wish to acknowledge the assistance of my friend and colleague Deputy Michael Fitzmaurice, who is in the Visitors' Gallery with a representative of the Carrick-on-Shannon Chamber of Commerce, and Mr. John Dunne, who has corresponded with the Minister of State on behalf of the Carrick-on-Shannon Chamber of Commerce. I will read out some of the...

Seanad: Flooding: Statements (20 Jan 2016)

Paschal Mooney: While Tip O'Neill said that all politics was local, I am not suggesting that the Minister of State deliberately neglected or ignored the town. He has been to places all over the country. We are asking him, however, to take the time to meet the local flood committee and the chamber of commerce in Carrick-on-Shannon in light of the proposals they have put forward to him and in order that he...

Seanad: Flooding: Statements (20 Jan 2016)

Paschal Mooney: In fact, a significant portion of it can be implemented by the local authority which has also received that correspondence.

Seanad: Competition (Amendment) Bill 2016: Second Stage [Private Members] (20 Jan 2016)

Paschal Mooney: Like Senator Bacik, I will declare an interest, although not at the lofty level of being a barrister. I am a member of the National Union of Journalists, NUJ, and Irish Equity.
