Seanad: Parental Leave (Amendment) Bill 2004: Second Stage. (2 Feb 2005)

Tony Kett: He is only coming home at that stage.

Seanad: Parental Leave (Amendment) Bill 2004: Order for Second Stage. (2 Feb 2005)

Tony Kett: I move: "That Second Stage be taken today."

Seanad: Parental Leave (Amendment) Bill 2004: Second Stage. (2 Feb 2005)

Tony Kett: I welcome the Minister of State to the House and I thank him for introducing this important Bill. As he said, the Bill proposes to amend the Parental Leave Act 1998. It is also implementing part of an EU directive. It results from ongoing agreements between the social partners and the Government. The Bill is one of many necessary elements of the renewal and review of certain aspects of...

Seanad: Criminal Justice (Terrorist Offences) Bill 2002: Second Stage. (26 Jan 2005)

Tony Kett: I welcome the Minister and thank him for his most comprehensive analysis of the Bill. As Senator Cummins outlined, the Bill is set against the backdrop of the devastating and traumatic events of 11 September 2001 and the other serious terrorist acts which took place at that time. We witnessed in graphic detail what human life means to these people who justify their actions by means of one...

Seanad: Garda Síochána Bill 2004: Committee Stage (Resumed). (14 Dec 2004)

Tony Kett: Is there any required level of physical fitness for gardaí? There are some gardaí from whom, even at my age, I could get away in the event of a chase.

Seanad: Garda Síochána Bill 2004: Committee Stage (Resumed). (14 Dec 2004)

Tony Kett: I agree with Senator Jim Walsh. Many gardaí are tied up through working in locations such as court buildings, and are over-trained for this work. I disagree with Senator Cummins. At a time when more gardaí are needed on the streets doing the work they are trained for, it would be wise to adopt this measure.

Seanad: Garda Síochána Bill 2004: Committee Stage (Resumed). (14 Dec 2004)

Tony Kett: I am inclined to agree with Senators Brian and Maurice Hayes. It seems to me that the element of surprise is one of the ombudsman's better tools when raiding a Garda station. If one will have to go to the Garda Commissioner to seek his permission before doing so, the power of the investigation would surely be damaged if — God forbid — the Garda Commissioner were involved in any form of...

Seanad: Garda Síochána Bill 2004: Committee Stage (Resumed). (10 Dec 2004)

Tony Kett: I agree with the Minister and the old adage that three heads are better than one. A permanent chairman should not be appointed as three people will bring to the commission their individual talents. While it might be useful to appoint a chairman when considering particular cases in respect of which he or she has more experience than the other members of the commission, it is best to operate in...

Seanad: Garda Síochána Bill 2004: Committee Stage (Resumed). (10 Dec 2004)

Tony Kett: I take a different view. The fact that people are coming from an investigative background enhances the ability of the commission to be effective. Such people will have had vast experience in these systems. As well as that, they will be under new guidance. The person that cracks the whip, in effect, will be driving them. I would be more worried, on my reading of the Bill, as to whether people...

Seanad: Proceeds of Crime (Amendment) Bill 1999: Report and Final Stages. (10 Dec 2004)

Tony Kett: I thank the Minister and his officials for their assistance in helping us to understand all the aspects of the Bill which enhances the Proceeds of Crime Act 1996 and the Criminal Assets Bureau Act 1996. This legislation will enable those working at the coalface to tackle individuals living on means not legitimate to their way of life. Such people are involved in murky business for the...

Seanad: Proceeds of Crime (Amendment) Bill 1999: Second Stage. (24 Nov 2004)

Tony Kett: Next Tuesday, 30 November.

Seanad: Proceeds of Crime (Amendment) Bill 1999: Second Stage. (24 Nov 2004)

Tony Kett: I welcome the Minister of State to the House. He is a former colleague of mine from our days on Dublin City Council. It is good to have him here. I am grateful for the opportunity to say a few words on this amending legislation. As the Minister of State said, the Proceeds of Crime (Amendment) Bill 1999 was introduced to amend aspects of the Proceeds of Crime Act 1996. It will ensure that the...

Seanad: Order of Business. (18 Nov 2004)

Tony Kett: I ask that consideration be given to providing time for a debate on the needs of the elderly. Experts predict we will have one of the coldest winters on record and Age Action Ireland tells us that between December and March there will be as many as 2,000 weather-related deaths among the elderly. It is a statistical fact that in the winter months the mortality rate in Ireland is 23% compared...

Seanad: Order of Business. (9 Nov 2004)

Tony Kett: I support the comments of my colleague, Senator Glynn, on the issue of fireworks. Legislation is in place for the enforcement of the Act. However, if it is not enforced, we must ask why. The Minister for Justice, Equality and Law Reform must explain to the House why it is not enforced. The same goes for bonfires which are not covered by any legislation. On bonfire night in Dublin city, parks...

Seanad: Garda Recruitment: Motion. (20 Oct 2004)

Tony Kett: I welcome the Minister to the House and congratulate him on his restatement of the commitment given in the programme for Government. While he did not have to restate it for those of us on this side of the House, the fact that he has done so will probably change the tune of the Opposition who will have to find something else to crow about. I read nothing which stated the Minister would meet...

Seanad: Garda Recruitment: Motion. (20 Oct 2004)

Tony Kett: The problem of street violence involving young people late at night continues to be of great concern to all. It is an issue which needs to be tackled head on. That type of crime threatens the very fabric of society. We can no longer afford to allow teenagers or adults to act like drunken hooligans in our towns, cities and villages. The public order Bill and the Intoxicating Liquor Bill,...

Seanad: Intoxicating Liquor Bill 2004: Committee and Remaining Stages. (13 Oct 2004)

Tony Kett: I congratulate the Minister too. As I said earlier, the Minister brings legislation to the House every time he comes here. Something will be gained every time we talk about the subject matter of the Bill before the House. Some people have said that we should have seen this problem coming, but the practical application of legislation is sometimes the best way to proceed, especially if...

Seanad: Intoxicating Liquor Bill 2004: Second Stage (Resumed). (13 Oct 2004)

Tony Kett: I welcome the Minister for Justice, Equality and Law Reform to the House. I also welcome the minor amendment which has been made to the Bill, which is important, as the Minister has said. I am glad that the Minister has not been lambasted in this House for rushing all Stages of the Bill through in one day. I listened to some of the Dáil debate on the Bill, during which the Minister was...

Seanad: Disability Services: Motion. (29 Sep 2004)

Tony Kett: I thank all the speakers who contributed to the debate. I am sure it has been as illuminating for the Minister of State as it has been for me. While we are all debating the same issue and while we might engage in political argument about how we mean to go about it, one thing that is certain is that we are all on the same wavelength in terms of what we want to do. We want to improve the lot of...

Seanad: Disability Services: Motion. (29 Sep 2004)

Tony Kett: I move: That Seanad Éireann: —recognises the ongoing commitment of the Government to put a programme of action in place to support and reinforce equal participation in society by people with disabilities; —congratulates the Government for bringing forward a Disability Bill honouring the pledge in the programme for Government; —fully supports the recently announced national disability...
