Seanad: Child Care Services: Statements. (22 Feb 2005)

Tony Kett: I feel inadequate and vulnerable——

Seanad: Child Care Services: Statements. (22 Feb 2005)

Tony Kett: ——after listening to Senator Cox's in-depth, realistic life experiences and knowing that Senator White has made this one of her main issues since becoming a Member of the House. Not having the in-depth knowledge or the hands on experience of these ladies, I am thankful at this stage that my family is almost reared. There has been massive social and economic change in this country,...

Seanad: Civil Partnership Bill 2004: Second Stage. (16 Feb 2005)

Tony Kett: He is here all the time.

Seanad: Civil Partnership Bill 2004: Second Stage. (16 Feb 2005)

Tony Kett: I move amendment No. 1: To delete all words after "That" and substitute the following: "Seanad Éireann declines to give a second reading to the Bill so as to permit further consideration of important legal and constitutional issues and in particular (a) the resolution of current litigation regarding the recognition of a foreign same sex marriage; (b) finalisation by the All-Party Oireachtas...

Seanad: Civil Partnership Bill 2004: Second Stage. (16 Feb 2005)

Tony Kett: The Bill could represent a contravention of the fundamental requirements of the Constitution. It proposes to treat as equal all conjugal relationships involving cohabiting partners. Under Article 41, they are not equal. Additionally, while seeking to vindicate the rights of cohabiting couples, it ignores the duties that come with their relationships, including the duties of care to children...

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: There is reasonable flexibility on both sides without having to go down this road. Most employers would in genuine terms rather see an employee take two rather than eight weeks. I do not think it would create a problem. If it did down the road, we could return and amend the provision if there is an argument thereafter.

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: I agree with Senator O'Toole's sentiments on this matter. Like Senator Terry I know of no employer with any semblance of decency who could refuse a parent time in such circumstances. While not wishing to sound pro-employer, an employee, however, could use this provision to get out of work.

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: The employee could say his or her child is in the school. The employer must have some proof that he or she is legitimately——

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: That would be fine. However, an employee could come to an employer, as I have experienced, and say his or her child is sick in school and must be collected.

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: It happens. If one is going to protect the employer——

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: That is taking it to the extreme.

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: Next Tuesday.

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: He is always at it.

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: We can hope Senator O'Toole wins the argument next time.

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: I do not see the need for this provision because most employers by their very nature would be very flexible in such a situation. If I was an employer, I would rather see someone take leave for two weeks rather than eight, particularly if I had to employ another person and continue to pay both while the employee was on leave. Much of this places an onus on the employer to give a reason he or...

Seanad: Privacy and Defamation: Statements. (9 Feb 2005)

Tony Kett: I welcome the Minister to the House. I do not know whether we should be kind to him and offer him a bed or be unkind and charge him rent, given that he is spending so much time in the House. I welcome the opportunity to contribute to this debate. It is a topic which is offering different opinions. Before legislation is afoot, much difficulty and emotion will be expressed before it is all done...

Seanad: Parental Leave (Amendment) Bill 2004: Committee Stage. (9 Feb 2005)

Tony Kett: I raised this matter because the age limit is 16 years but for children with a disability there is a transition period between the age of 16 and 18. That comes about in two ways. Many special school programmes now incorporate the junior certificate and many of these children, as we call them, come out of the junior certificate level at 16 years of age into an immediate transitional period...

Seanad: Criminal Justice (Terrorist Offences) Bill 2002: Committee Stage (Resumed). (8 Feb 2005)

Tony Kett: On Thursday.

Seanad: Criminal Justice (Terrorist Offences) Bill 2002: Committee Stage. (3 Feb 2005)

Tony Kett: Is it the case that if I phone somebody it is possible for the phone companies to have the content of the conversation without a pre-tap? If I make a threatening phone call to a person who then complains to the Garda, can the Garda elicit the content of the phone call from the phone company?

Seanad: Order of Business. (3 Feb 2005)

Tony Kett: I endorse the comments congratulating Senator Quinn on his most recent award. At a time when people with disabilities are still struggling for a measure of equality, it is gratifying to know there are people like Senator Quinn in business. I read last week about a pub in Temple Bar in which there was a toilet door marked for disabled use but behind which there was nothing but a wall. With...
