Land and Conveyancing Law Reform Bill 2006 [Seanad]: Second Stage (4 Oct 2007)

Charles Flanagan: In essence the Bill reduces the number of estates or varying degrees of ownership to two. This will provide a more definite and certain concept of land ownership. The two basic types of ownership will remain freehold or fee simple interest and estate with absolute freehold interest with or without encumbrances, and leasehold, a type of tenancy with covenants and conditions restricting...

Land and Conveyancing Law Reform Bill 2006 [Seanad]: Second Stage (4 Oct 2007)

Charles Flanagan: We mentioned the changes in the law relating to co-ownership. Section 28 of the Bill will give the right to sever the joint tenancy in favour of a tenancy in common, with the result that right of survivorship may no longer operate on the demise of the joint tenant, provided that all the persons entitled to the joint tenancy down the line would be adequately notified. Notice and knowledge...

Garda Strength. (9 Oct 2007)

Charles Flanagan: Question 93: To ask the Minister for Justice, Equality and Law Reform if he is satisfied that the Garda Síochána is sufficiently resourced to tackle gangland crime; and if he will make a statement on the matter. [22611/07]

Garda Strength. (9 Oct 2007)

Charles Flanagan: As we awoke this morning to the news of yet another gangland murder in our community I put it to the Minister that not enough is being done to resource the Garda Síochána. In saying that, I accept the Garda Síochána alone will not solve the crime crisis. There is a need for a community response. However, this community response must be led by a properly resourced and properly equipped...

Garda Strength. (9 Oct 2007)

Charles Flanagan: Does the Minister agree that these gangsters are not living in fear of anybody and that there is now a subculture of vicious crime that needs to be addressed? Does he agree that the standard stage-managed response of the Government over the past five years or more has been to say that, on foot of a meeting with the Garda Commissioner, the Minister has been assured the question of resources...

Recidivism Rate. (9 Oct 2007)

Charles Flanagan: Question 95: To ask the Minister for Justice, Equality and Law Reform the steps he will take to deal with the high level of repeat offending within the criminal justice system; and if he will make a statement on the matter. [22612/07]

Recidivism Rate. (9 Oct 2007)

Charles Flanagan: I am not sure how much of the Minister's reply remains unannounced and will be stitched into the Official Report but I regret that his answer so far gave absolutely nothing in terms of a positive response as to what plan the Government might have to deal with this issue. I refer to the stark statistics quoted by the Minister. Within four years of release, more than half of these offenders...

Recidivism Rate. (9 Oct 2007)

Charles Flanagan: They get out and then go back in.

Recidivism Rate. (9 Oct 2007)

Charles Flanagan: A total of 87% of those jailed for defaulting on fines are back in jail within a four-year period. This is indicative that the system is failing. Will the Minister set about putting in place a national support system for prisoners on their release, to assist integration in the community and to reduce the stark but real statistic on those who return to jail within a four-year period?

Residency Permits. (9 Oct 2007)

Charles Flanagan: There are no telephones.

Proposed Legislation. (9 Oct 2007)

Charles Flanagan: The Minister did not say his proposed legislation would mirror that of the LRC but I assume that may well be the case. There is an anomaly in the current system in so far that if a criminal conviction is struck out by the courts, the details remain on the Garda's records, with particular reference to data protection. I am not sure of the extent to which this has been covered by the LRC but...

Leaders' Questions (9 Oct 2007)

Charles Flanagan: It has been in testing for years.

Written Answers — Garda Communications: Garda Communications (9 Oct 2007)

Charles Flanagan: Question 107: To ask the Minister for Justice, Equality and Law Reform the number of members of An Garda Síochána who have corporate e-mail addresses; the factors impeding greater use of corporate e-mail by Gardaí; if measures are in place to increase the usage of corporate e-mail by An Garda Síochána; and if he will make a statement on the matter. [22532/07]

Written Answers — Garda Equipment: Garda Equipment (9 Oct 2007)

Requests to move Adjournment of Dáil under Standing Order 32 (10 Oct 2007)

Charles Flanagan: I seek the adjournment of the Dáil under Standing Order 32 to raise the following urgent matter: the recently published report of the Council of Europe sub-committee outlining disturbing shortcomings in our prison system and the need for immediate action thereon.

Order of Business (10 Oct 2007)

Charles Flanagan: Were they the same people to whom the Minister of State, Deputy Roche, spoke in connection with this matter?

Written Answers — Social and Affordable Housing: Social and Affordable Housing (10 Oct 2007)

Charles Flanagan: Question 113: To ask the Minister for the Environment, Heritage and Local Government the number of affordable houses that will be delivered under Part V in 2007; and if he will make a statement on the matter. [22751/07]

Establishment of Committees (11 Oct 2007)

Charles Flanagan: With the agreement of the House, I will share time with Deputy Rabbitte. Debates involving Dáil reform usually attract the ire of the Opposition rather than of Government. I have a sense of déjÀ vu. Not having been a Member of the Dáil for five years I find this debate remarkably similar to debates which might have taken place ten or 12 years ago. This is indicative of our slow pace of...

Establishment of Committees (11 Oct 2007)

Charles Flanagan: The Taoiseach must come into the way.

Irish Prison Service. (11 Oct 2007)

Charles Flanagan: I thank the office of the Ceann Comhairle for facilitating me in raising this matter and I thank the Minister of State for coming before the House to debate it. This week, the Council of Europe's internationally respected Committee for the Prevention of Torture again shone a light on Ireland's prisons. The picture that emerged was deeply shocking. In short, Ireland's prisons are dominated...
