Charles Flanagan: The question could arise of whether Mr. X, who is before the court, is a director of the gang. One cannot say that the evidence given does not lead to a conviction as it is fundamental to the leading to a conviction. The existence of a gang would be established and one would follow on to establish whether the person before the court is a member or participant in that gang.
