He made the recommendation that he was not able to determine the truth after analysing both protected disclosures. The terms of reference were drafted by him.

Enda Kenny: The protected disclosures received by the Minister for Justice and Equality are not public information. No member of the Cabinet other than the Minister had access to those files. When they were referred to Mr. Justice O'Neill he considered them and made his recommendation for a commission of investigation, giving the suggested terms of reference.
