Mary Harney: The Deputy's question relates to the management and delivery of health and personal social services, which are the responsibility of the Health Service Executive under the Health Act 2004. Accordingly, the Department has requested the Parliamentary Affairs Division of the Executive to arrange to have this matter investigated and to have a reply issued directly to the Deputy.

Mary Harney: Sexual assault is an alternative charge and an alternative verdict that can be made in these cases. That is important to recognise. As I have said to Deputy Kenny, it is intended that the Minister for Justice, Equality and Law Reform will discuss this matter at the Cabinet meeting on Tuesday, and we expect to have legislation within a fortnight.

Mary Harney: The heads of the pharmacy (No. 1) Bill were cleared by Cabinet recently and I hope to publish them next week for consultation. We hope to have the Bill in the House later this year. The pharmacy (No. 2) Bill, which deals with more technical rather than regulatory issues to do with the profession, will be ready later this year or early next year.
