Public Accounts Committee: Business of Committee (7 Dec 2023)

Paul McAuliffe: Yes. It is matter of how we approach this as a committee. My recollection of the last time the GSOC representatives were with us is that one of the significant areas of concern was the delays in terms of finalising complaints, particularly regarding persons under the age of 18. There was a very key, albeit a diplomatic answer, that the funding of GSOC was a key factor in that. I wonder...

Public Accounts Committee: Business of Committee (7 Dec 2023)

Paul McAuliffe: Yes.

Public Accounts Committee: Business of Committee (7 Dec 2023)

Paul McAuliffe: Given the debate around the use of force and how free gardaĆ feel to be able to use that discretionary power, etc., delays in GSOC are a key factor and we should press the matter, if we can, at the meeting.

Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Residential Tenancies (Right to Purchase) Bill: Discussion (Resumed) (7 Dec 2023)

Paul McAuliffe: There is an interaction between the notice periods, the restriction which we put on where a landlord can sell and this right. I suppose that is where the interactions we have just had are useful in this phase of the process. I wonder if FAQs might be developed, even at a draft stage, that would help us to understand some of the implications of the legislation. The previous round of...

Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Residential Tenancies (Right to Purchase) Bill: Discussion (Resumed) (7 Dec 2023)

Paul McAuliffe: There is nothing in the Bill that stops the landlord from achieving the full market value. There is nothing in it that forces them to wait until the other end of the notice period. In fact, we are providing a period before. That is really important. I think it was the Chair that indicated the last time that there was a perception being sent out that this was another burden on landlords....

Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Residential Tenancies (Right to Purchase) Bill: Discussion (Resumed) (7 Dec 2023)

Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Residential Tenancies (Right to Purchase) Bill: Discussion (Resumed) (7 Dec 2023)

Paul McAuliffe: There should be some obligation on the tenant, whether that is dealt with in legislation or elsewhere, to ensure that viewings are appropriately dealt with and that there is not an attempt to frustrate a process. We are extending a right to a tenant here, and in those cases it is not unreasonable that we might also extend an obligation. The Department should reflect on that to see how it...

Joint Oireachtas Committee on Housing, Planning and Local Government: General Scheme of the Residential Tenancies (Right to Purchase) Bill: Discussion (Resumed) (7 Dec 2023)

Planning and Development Bill 2023: Second Stage (Resumed) (6 Dec 2023)

Paul McAuliffe: I have some sympathy with Deputy McNamara in trying to get to grips with a Bill that could be a small brick in a house, with considerable length and detail. As the Vice Chair of the Oireachtas housing committee, both I and other members, including Deputies Higgins and Matthews, have had the opportunity to consider this legislation at pre-legislative scrutiny for some time. Even with that,...
