Marc MacSharry: Is there company law that governs any of these things?
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: Is there any law relevant to it that we are aware of? I am sorry to put the Comptroller and Auditor General on the spot, it may not be his area at all. There are also Department representatives before the committee. I would be interested in the Department's thinking on appointing the regulated to be a member of the regulatory authority.

Marc MacSharry: Absolutely. However, if our starting point is to make the fox the head of security for the hen house, it does not give the hens much confidence, that is all.

Marc MacSharry: Would there be any retired members from various charities that could have been considered instead?
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: That is great. However, on this occasion the decision was to get someone who was an active CEO of the Irish Wheelchair Association. Again, this is not about the individual at all. I am sure they are more qualified than anyone else in the whole country but that is not the point; the point is that it is poor practice.
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: There is nothing to restrict them from applying but we look to the Department and perhaps, ultimately, the Minister, to apply a bit of common sense that the regulated does not become the regulator while continuing to be regulated. Does anyone agree with me or am I on a different planet?

Marc MacSharry: We are not talking about grants here.
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: We are talking about oversight and the making of the rules of the game. I must say as a member of the committee, I think that it is shocking governance, without prejudice to the wonderful expertise of the individual we are talking about. As a matter of basic rules, to give people the peace of mind to which they are entitled, the regulated should never, while continuing to be regulated, have...
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: The regulator has no view and no competence. Would it have come up, with the head of the IWA being on the board, during any discussions? Would it have been mentioned?
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: Does the regulator examine the finances of the charities that it regulates?
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: The IWA would be a section 39 organisation, is that correct?
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: The Comptroller and Auditor General cannot audit any of these organisations obviously, so they do not have to give him their accounts.
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: The regulator is waiting for an amendment. The regulator does not have the full suite of powers and tools which a regulator should have, and amendments and additions to legislation are pending, is that the case?
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: Have there been any concerns about the IWA?
- Public Accounts Committee: 2018 Financial Statements of the Charities Regulatory Authority (21 Nov 2019)
Marc MacSharry: Clearly we have to get the legislation sorted for the regulator so that it can do that. Some charities are limited companies and others are just -----
