Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Construction Contracts Bill 2010: Committee Stage (15 May 2013)

Brian Hayes: I cannot comment on whether they were aware. The date for this committee meeting was set, amendments were tabled by colleagues and we tabled our amendments. It is not a question of whether they could have been aware of it one way or another. When they were published they were in the public domain. I fully accept there is a very strong view on the issue. I still have an open view on it...

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Construction Contracts Bill 2010: Committee Stage (15 May 2013)

Brian Hayes: Supply and install.

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Construction Contracts Bill 2010: Committee Stage (15 May 2013)

Brian Hayes: If they are installed.

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Construction Contracts Bill 2010: Committee Stage (15 May 2013)

Brian Hayes: That could be put into a contract. The great dilemma in this area arises as a result of the lack of contracts. That is why we are here discussing the Bill. There is nothing to stop the subcontractor as part of that overall contract putting that as a condition. That would mean that if one designs and installs the structure, it is totally operable within the context of the Bill.

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Construction Contracts Bill 2010: Committee Stage (15 May 2013)

Brian Hayes: I believe the debate is changing, if we are really being honest about this. Deputy Fleming had submitted an amendment on bespoke materials. Bespoke is not similar to ready-mixed concrete, is it? I understand the concrete lobby is seeking to have this included. However, let us be honest. That is not bespoke or one-off.

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Construction Contracts Bill 2010: Committee Stage (15 May 2013)

Brian Hayes: It is not the same thing.

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Construction Contracts Bill 2010: Committee Stage (15 May 2013)

Brian Hayes: We need to be honest about what we are saying. Deputy McDonald reminded me about what I undertook. It is always good to read what one said about a year and a half ago. It is always good to put it on the record - she might do it herself the odd time. At the time we looked at the question of bespoke items. We have looked at this question and it is difficult. We need to make a distinction,...

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Construction Contracts Bill 2010: Committee Stage (15 May 2013)

Brian Hayes: I move amendment No. 2: In page 4, subsection (1), line 20, to delete paragraph (g).The amendment provides for the exclusion of mining and drilling operations from the scope of the Bill. Currently section 1(1)(g) includes mining and exploration as a construction activity. These activities should not have been included because similar activities are specifically excluded from the definition...

Committee on Finance, Public Expenditure and Reform: Select Sub-Committee on Public Expenditure and Reform: Construction Contracts Bill 2010: Committee Stage (15 May 2013)

Brian Hayes: There is broad acceptance of the amendment proposed, but in fairness to Deputies Fleming and McDonald I should reply to the issues they raised, as it is a key issue that we must debate. That is the purpose of Committee Stage. It is a good thing. Four outstanding issues emerged from the regulatory impact statement. Members will see that the amendments I proposed, which broadly have the...

Written Answers — Department of Public Expenditure and Reform: Public Park Access (9 May 2013)

Brian Hayes: The bye-laws relating to the Phoenix Park are on public display at the following entrances: Parkgate Street, Chapelizod Gate, Islandbridge Gate and North Circulare Gate. Copies of the bye-laws are available on the Phoenix Park website (www.phoenixpark.ie) for all local communities and the general public at large.

Seanad: Adjournment Matters: Departmental Staff Redeployment (2 May 2013)

Brian Hayes: I thank Senator Mooney for raising this matter. Following the successful reorganisation of the Department's local office structure, which resulted in the reduction from 58 to 16 of the local offices, and in the context of the Croke Park agreement which committed the public sector, including the Department of Agriculture, Food and the Marine, to maximise efficiencies and productivity in the...

Seanad: Adjournment Matters: Departmental Staff Redeployment (2 May 2013)

Brian Hayes: I will not comment on the Department of Agriculture, Food and the Marine side but, wearing my public sector reform hat, I would say what the Senator said is right. We are trying to reconfigure the entire system to get greater efficiencies. In a circumstance where we have taken 30,000 people out of the public sector and more are to go, we must do this but the way we do it is the key. It is...

Seanad: Adjournment Matters: Carbon Tax Implementation (2 May 2013)

Brian Hayes: I will speak to the Minister, Deputy Noonan, and raise the substantive issue the Senators have raised with him. There is a general issue with these Adjournment matters. If Members are not specific about the point, they will receive a general reply.

Seanad: Adjournment Matters: Carbon Tax Implementation (2 May 2013)

Brian Hayes: I know from my years of experience in the House that the clearer the Member is in the matter tabled, the easier it is for the officials in the Department to know what they are seeking. That is the first point.

Seanad: Adjournment Matters: Carbon Tax Implementation (2 May 2013)

Brian Hayes: The Senator can give me a shout. I might be a help in that regard. With regard to the firelog, which Senator Brennan describes as a glorified firelighter, I do not wish to shunt responsibility to the Department of the Environment, Community and Local Government but my understanding is that the specification of what is and is not fossil fuel and what is and is not a by-product came from that...

Industrial Development (Science Foundation Ireland) (Amendment) Bill 2012: Referral to Select Committee (2 May 2013)

Brian Hayes: I move:That the Bill be referred to the Select Committee on Jobs, Enterprise and Innovation pursuant to Standing Orders 82A(3)(a) and (6)(a) and 126(1) of the Standing Orders relative to Public Business.

Seanad: Adjournment Matters: HSE Properties (2 May 2013)

Brian Hayes: That is a very relevant question, which the HSE must clarify. It would seem from the reply that no decision has been taken in respect of the totality of the property or parcels of the property. I note that as opportunities arise they will be looked at, but it would seem there are no plans currently. The HSE should engage with the local community and the Senator. The Senator's comments in...

Seanad: Adjournment Matters: Carbon Tax Implementation (2 May 2013)

Brian Hayes: I thank the Senators for giving me an opportunity to address this issue and thank them for their concern. The carbon tax on fossil fuels was introduced in budget 2010. It was applied to petrol and auto diesel from December 2009 and extended to kerosene, marked gas oil, liquid petroleum gas and natural gas with effect from May 2010. The carbon tax on fossil fuels was introduced in budget...

Industrial Development (Science Foundation Ireland) (Amendment) Bill 2012 [Seanad]: Second Stage (Resumed) (2 May 2013)

Brian Hayes: On behalf of the Minister of State, Deputy Sherlock, I thank the various Deputies for their contributions to the debate on this Bill. We are delighted to see unanimous cross-party support for this Bill, which is an acknowledgement of how important science and technology is to Ireland's economic and societal development. It is heartening to have had such an extensive discussion on SFI...

Seanad: Adjournment Matters: HSE Properties (2 May 2013)

Brian Hayes: I thank Senator Burke for raising this matter which is important for him and people in Cork city and concerns Our Lady and St Kevin's Hospital, Shanakiel. The Senator has also asked us to clarify the extent of the campus remaining in HSE ownership. Our Lady's Hospital was a mental health institution built in the 1840s. Its construction and size meant that it was not fit for purpose by...
