Select Committee on Enterprise, Tourism and Employment: Employment (Contractual Retirement Ages) Bill 2025: Committee Stage (2 Jul 2025)

Eoin Hayes: It would be at the discretion of the WRC or, if taken further, the courts.

Select Committee on Enterprise, Tourism and Employment: Employment (Contractual Retirement Ages) Bill 2025: Committee Stage (2 Jul 2025)

Eoin Hayes: I must admit that I am fairly new to law making. Is it typical to introduce legislation where something this significant is not defined?

Select Committee on Enterprise, Tourism and Employment: Employment (Contractual Retirement Ages) Bill 2025: Committee Stage (2 Jul 2025)

Eoin Hayes: The Minister spoke about the constitutional rights of employers.

Select Committee on Enterprise, Tourism and Employment: Employment (Contractual Retirement Ages) Bill 2025: Committee Stage (2 Jul 2025)

Eoin Hayes: What are the constitutional rights of employers?

Select Committee on Enterprise, Tourism and Employment: Employment (Contractual Retirement Ages) Bill 2025: Committee Stage (2 Jul 2025)

Eoin Hayes: I remain concerned. If a case goes to the WRC or the Judiciary, would the onus be on the employee to establish the violation of the legitimate aim or is it on the employer to defend that it is a legitimate aim?

Select Committee on Enterprise, Tourism and Employment: Employment (Contractual Retirement Ages) Bill 2025: Committee Stage (2 Jul 2025)

Eoin Hayes: I will ask a hypothetical question. Let us say a business says that it believes that it is "a legitimate aim" for the business to have somebody of a certain age fronting the house, say, for example in a restaurant or hospitality industry. Could that be used a defence in this particular scenario? Could it be enforced?

Select Committee on Enterprise, Tourism and Employment: Employment (Contractual Retirement Ages) Bill 2025: Committee Stage (2 Jul 2025)

Eoin Hayes: Those are all my questions.

Committee on European Union Affairs: Danish Presidency of the Council of the European Union: Ambassador of Denmark to Ireland (2 Jul 2025)

Eoin Hayes: I welcome the ambassador and his official. I thank them for coming in and making the time to do this. I also am honoured to have the other excellencies here today as well. I thank them for coming in. In these kinds of fora, the exchange of views is important and helpful. Sometimes, there are differing views on different things, but it is important to let us exchange those. From my...

Committee on European Union Affairs: Danish Presidency of the Council of the European Union: Ambassador of Denmark to Ireland (2 Jul 2025)

Eoin Hayes: I wanted to come back on something in particular I spoke about earlier, but more related to the MFF and how the Danish Presidency of the EU will pursue that. I noted in his comments he discussed a fiscally responsible approach to the MFF. There is now an opportune turning point in Europe to talk about how we think about fiscal responsibility in this new chapter of global geopolitics and...

Written Answers — Department of Housing, Planning, and Local Government: Housing Policy (1 Jul 2025)

Eoin Hayes: 46. To ask the Minister for Housing, Planning, and Local Government how he would advise this Deputy to respond to persons about Government housing policy, especially to those who are older, over 50 and renting, with no prospect of owning a home. [27449/25]

Joint Oireachtas Committee on Enterprise, Tourism and Employment: General Scheme of the Industrial Development (Miscellaneous Provisions) Bill 2025: Discussion (25 Jun 2025)

Eoin Hayes: I thank everyone for their contributions and for preparing for this meeting. I appreciate the witnesses taking the time to come before the committee. I should probably declare some past interest in that I used to be a consultant to EI client companies and have worked for IDA client companies. I have some familiarity with the area, although there is no financial interest since I entered...

Joint Oireachtas Committee on Enterprise, Tourism and Employment: General Scheme of the Industrial Development (Miscellaneous Provisions) Bill 2025: Discussion (25 Jun 2025)

Eoin Hayes: To be clear, regarding going over the threshold, there is still an ability to give grants above the threshold but it would require explicit Government approval through the Cabinet. Is that right?

Joint Oireachtas Committee on Enterprise, Tourism and Employment: General Scheme of the Industrial Development (Miscellaneous Provisions) Bill 2025: Discussion (25 Jun 2025)

Eoin Hayes: On consultant quality, and I realise this may be a loaded question because I was a consultant myself, it is a competitive environment and Mr. Hughes cannot go into the specifics of individuals and private areas, but there is a question regarding oversight of the quality of the consultants who are engaged with client companies. How is it proposed to make sure it is the case that these people...

Joint Oireachtas Committee on Enterprise, Tourism and Employment: General Scheme of the Industrial Development (Miscellaneous Provisions) Bill 2025: Discussion (25 Jun 2025)

Eoin Hayes: I can take the answer in writing, if the witnesses prefer. It does not necessarily have to be today.

Joint Oireachtas Committee on Enterprise, Tourism and Employment: General Scheme of the Industrial Development (Miscellaneous Provisions) Bill 2025: Discussion (25 Jun 2025)

Eoin Hayes: Yes, that is fine. On the detergent level, I have just noticed that in many enforcement mechanisms, more generally, instead of having an absolute number of, say, up to €3 million as a penalty, certainly in data protection and other realms, percentage of revenue seems to be a particularly coercive measure that gets the right kinds of behaviours. Is there any reason this particular...

Joint Oireachtas Committee on Enterprise, Tourism and Employment: General Scheme of the Industrial Development (Miscellaneous Provisions) Bill 2025: Discussion (25 Jun 2025)

Eoin Hayes: Okay. Specifically on the idea of an offence, and I am not a lawyer, so I am not sure if this is something most lawyers understand, but when something is named as an offence in legislation like this, what does this mean in terms of the enforcement mechanism that can then be applied?
