- Seanad: Order of Business. (24 Nov 2003)
Mary Henry: Like others I was truly shocked at the bombings in Istanbul. I am sure many Senators noted the words of Canon Ian Sherwood who spoke after the memorial service yesterday and who is a constituent of Dublin University. He said we need to address the reasons for these terrible atrocities. If the Leader can organise a debate on Iraq I hope we can extend it to include such issues.
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: I move amendment No. 2a: In page 9, between lines 20 and 21, to insert the following definition:â "'medical practitioner' means a registered medical practitioner as defined by section 5 of the Medical Practitioners Act 1978". I welcome the Tánaiste and Minister for Enterprise, Trade and Employment to the House. The words "medical practitioner" occur in section 11(3)(c) and in section 24....
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: I do not know if it is possible, but could one state that a medical practitioner means what I have stated in my amendment under section 11 of this Bill? That would obviate the problem in section 24. It is only under section 24 that we refer people outside the State, unless we are going to start taking reports from people outside the State, which would be possible. People must have some type...
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: I would like the Minister to reconsider this because the patient might consider that he or she had received better satisfaction from whoever he or she had gone to and that he or she was better off getting a report from that person. This is a new area. One could find that some people rapidly become professionals at giving such reports. I hope I am forgiven for saying it, but I have seen some...
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: I move amendment No. 6a: In page 12, subsection (3)(e), line 3, after "injuries" to add the following:
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: It would be rude to withdraw it before hearing the Minister's reply.
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: When one seeks a report, there is implied consent. However, we have been warned by the Medical Protection Society and the Medical Defence Union to get informed consent from the patient. In other words, it must be explained in one syllable. The report Managing and Protecting the Privacy of Personal Health Information in Irish General Practice states: ..it is appropriate that the medical...
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: I thought the Bill states that the report could be seen by other people.
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: I understood the Bill states that the reports are not private.
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: What will be the position regarding data protection legislation? Will people be able to access the workings of the board?
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: Will the wider public be able to access the workings of the board?
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: What about the medical reports?
- Seanad: Personal Injuries Assessment Board Bill 2003: Committee Stage. (24 Nov 2003)
Mary Henry: I will have to consider the issue but in the meantime I will withdraw the amendment. Amendment, by leave, withdrawn. Section 11 agreed to. Section 12 agreed to. SECTION 13.
- Seanad: Order of Business. (20 Nov 2003)
Mary Henry: I support Senator Brian Hayes's call for a debate on men's health, but perhaps it should be narrowed to men's health under the cancer strategy. Perhaps the Minister for Health and Children could come to the House to consider this area specifically as there appears to be an increasing rate of prostate cancer and the age of those developing it is becoming younger. Testicular cancer is an...
- Seanad: Personal Injuries Assessment Board Bill 2003: Second Stage. (20 Nov 2003)
Mary Henry: I welcome the Minister to the House and I welcome the Bill. I sometimes wonder whether people make personal injury claims as the only way to get a public authority to take any notice of what has happened to them. I speak from personal experience. I try to walk as much as possible around the city rather than bringing my car or even taking public transport. It is extremely difficult to keep...
- Seanad: Order of Business. (19 Nov 2003)
Mary Henry: I second the amendment to the Order of Business as proposed by Senator Norris to allow a short debate on No. 1. It is not clear whether Irish citizens no matter how young may also be deported on these flights. I draw the Leader's attention to the very short notice we were given of the publication of the Personal Injuries Assessment Board Bill, which is to be debated here tomorrow. I am sure...
- Seanad: Stem Cell Research: Statements. (19 Nov 2003)
Mary Henry: Having sought a debate on this important topic, I thank the Leader for organising it. I also thank the Tánaiste for coming to the House to discuss this matter and for the clarity of her contribution. I wish to begin with a question, which no other Member may pose. The aim of the directive is to introduce guidelines and restrictions on embryonic stem cell research. A moratorium has been put...
- Seanad: Stem Cell Research: Statements. (19 Nov 2003)
Mary Henry: It also applies in Germany.
- Seanad: Estimates for 2004: Motion. (19 Nov 2003)
Mary Henry: I welcome the Minister. I do not have to declare an interest to her because she is aware that I am the president of Cherish, the lone parents organisation, and she attended at many of our openings in the past. This is another occasion on which I am forced to wonder if the right arm of the Government knows what the left arm is doing.
- Seanad: Estimates for 2004: Motion. (19 Nov 2003)
Mary Henry: This week I attended the launch, by the Minister for Health and Children, of the Crisis Pregnancy Agency's strategy. The first five recommendations of the strategy are totally ignored and denigrated by the various actions that are being taken in the Book of Estimates. A considerable amount of money has been given to the Crisis Pregnancy Agency in order to reduce the level of crisis...
