This penalty was not appealed and a letter issued on 29 October 2008 informing her that the penalty in the amount of â¬850.67 would be deducted from her next payment. The deduction was made from a payment which issued on 1 December 2008.

Brendan Smith: In the case of ineligible applications, EU Regulations allow no possibility of adjusted plans being accepted after the closing date of 15 May 2008 if they are to qualify for 2008 payments. The farmers concerned will have to submit new applications and plans by 15 May 2009 to receive payment in 2009, and they will not be eligible for any payment for previous years.
